B. Introduction and adoption by first reading of Ordinance No. 747 Repealing Ordinance No. 678\nterminating Development Agreement No. 18-016C, between the City of Cudahy and Genius\nDistribution, LLC (page 1041)\nPresented by the Community Development Director\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open public hearing and receive comments and testimony; and\n2. Make a determination that Genius Distribution, LLC (“Operator”) is\nnot in compliance with the terms and conditions of its Development\nAgreement (“DA”) No. 18-016C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 747 (Attachment\nA) repealing Ordinance No. 678 terminating DA No. 18-016C,\nbetween the City of Cudahy and Genius Distribution, LLC; and\n4. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
