A. Introduction and adoption by first reading of Ordinance No. 746 Repealing Ordinance No. 681\nterminating Development Agreement No. 18-021C, between the City of Cudahy and Davina, LLC\n(page 87)\nPresented by the Community Development Director\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open public hearing and receive comments and testimony; and\n2. Make a determination that Davina, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-021C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 746 (Attachment\nA) repealing Ordinance No. 681 terminating DA No. 18-021C,\nbetween the City of Cudahy and Davina, LLC; and\n4. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
