C. Introduction and adoption by first reading of Ordinance No. 748 repealing Ordinance No. 682\nterminating Development Agreement No. 18-022C, between the City of Cudahy and Herbal\nDragon, LLC (page 1949)\nPresented by the Community Development Director\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open public hearing and receive comments and testimony; and\n2. Make a determination that Herbal Dragon, LLC (“Operator”) is not in\ncompliance with the terms and conditions of its Development\nAgreement (“DA”) with the City and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading, Ordinance No. 748 (Attachment\nA) repealing Ordinance No. 682 terminating DA No. 18-022C,\nbetween the City of Cudahy and Herbal Dragon, LLC; and\n4. Determine these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
