B Consideration and possible action to adopt Resolution No. 24-54 – A\nResolution adopted pursuant to Public Contracts Code § 20168 finding that\nan emergency exists within the City and authorizing contracting without the\nneed for bidding pursuant to § 20168 and Bellflower Municipal Code (“BMC”)\nChapters 3.28 and 8.36.\nCEQA: The emergency and extended repairs are categorically exempt from the\nrequirements of the California Environmental Quality Act (CEQA) pursuant to 14\nCalifornia Code of Regulations § 15269 (demolition of the identified facilities is\nnecessary to prevent or mitigate an emergency) and § 15301 (Existing Facilities). The\nexpected action would demolish structures constituting a threat to public health and\nsafety with no expansion of the existing use. The project is not anticipated to have any\nsignificant impacts regarding traffic, noise, air quality, or water quality. Additionally, the\nCity Council’s actions are exempt from additional CEQA review as they are being\nmade to protect public and private property and necessary to maintain services\nessential to the public, health and welfare (see, CalBeach Advocates v. City of Solana\nBeach (2002) 103 Cal.App.4th 529: CEQA findings regarding an anticipated imminent\nemergency are valid).\nRecommendation to City Council: 1) Adopt Resolution No. 24-54, declaring an\nemergency and authorizing contracting without formal bidding pursuant to Public\nContracts Code § 20168 and Bellflower Municipal Code (BMC) sections 3.28.090\nand 8.36.160, and Chapter 8.40; 2) Authorize the City Manager to execute a\nstandard public works contract, in a form approved with the City Attorney, with a\ncontractor to perform demolition for buildings located on the property located at\n9103-9123 Artesia Boulevard; 3) Authorize the City Attorney to initiate litigation to\nabate any public nuisance on the property and take all legal actions required to\nensure the City’s recovery of costs; or 4) Alternatively, discuss and take other\naction related to this item.
