64. Marina del Rey Back Basins Stormwater Improvements Project\nConstruction Contract\nRecommendation: Establish and approve the Marina del Rey Back Basins\nStormwater Improvements Project, Capital Project (CP) No. 69881 (Project)\nin the unincorporated community of Marina del Rey (2), with a total Project\nbudget of $4,134,000; approve an appropriation adjustment to transfer\n$1,024,000 from the Unincorporated Area Stormwater Quality\nImprovements, CP No. 87195, to fully fund the proposed Project; adopt the\nplans and specifications that are on file for the Project; advertise for bids to\nbe received before 11:00 a.m. on October 16, 2024; find pursuant to State\nPublic Contract Code, Section 3400 (c) (2) and (3), that it is necessary to\nspecify designated items by specific brand name in order to match other\nproducts in use on a particular public improvement either completed or in\nthe course of completion, and to obtain a necessary item that is only\navailable from one source; find that the proposed Project is exempt from the\nCalifornia Environmental Quality Act; and authorize the Director of Public\nWorks to take the following actions: (Department of Public Works)\nAPPROVE\nDetermine whether the bid of the apparent responsible contractor\nwith the lowest apparent responsive bid is, in fact, responsive and, if\nnot responsive, determine which apparent responsible contractor\nsubmitted the lowest responsive bid, waive inconsequential and\nnonmaterial deficiencies in bids submitted, and determine, in\naccordance with applicable contract and bid documents, whether the\napparent lowest responsive and responsible bidder has satisfied all\nconditions for contract award;\nAward and execute a construction contract for the Project to the\nresponsible contractor with the lowest responsive bid within the\napproved total budget; and\nExtend the date and time for the receipt of bids, allow substitution of\nsubcontractors and relief of bidders, approve and execute change\norders within the same monetary limits delegated to the Director,\naccept the Project upon its final completion, and release retention\nmoney withheld.
