4-A. A PUBLIC HEARING TO CONSIDER INTRODUCING AN ORDINANCE APPROVING A\nDEVELOPMENT AGREEMENT (DA-24-01) BY AND BETWEEN THE CITY OF MONTEREY\nPARK AND ATLANTIC SQUARE, LLC (TRC) TO FACILITATE IMPROVEMENTS ON AND\nADJACENT TO THE ATLANTIC SQUARE SHOPPING CENTER LOCATED AT 2100 SOUTH\nATLANTIC BOULEVARD; TO ACTIVATE THE BUSINESS RECOVERY DEVELOPMENT\nAGREEMENT ZONE (“BRDZ”) IN MONTEREY PARK MUNICIPAL CODE CHAPTER 21.45;\nAND TO AMEND THE ZONE MAP (ZA-24-02)\nIt is recommended that the City Council consider:\n(1) Opening the public hearing;\n(2) Receiving documentary and testimonial evidence;\n(3) Closing the public hearing;\n(4) Introducing and waiving first reading of an ordinance adopting DA-24-01 and amending\nthe zoning map (ZA-24-02). Second reading and adoption would occur on November 6,\n2024. The DA would become effective December 6, 2024; and\n(5) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City conducted an environmental review of the proposed project under the California\nEnvironmental Quality Act (Public Resources Code §§ 21000, et seq.), and the CEQA Guidelines\n(14 California Code of Regulations §§ 15000, et seq.) (“CEQA”) and determined it is categorically\nexempt pursuant to CEQA Guidelines § 15302 as a Class 2, replacement or reconstruction\nproject. Under CEQA Guidelines § 15004(b)(4), this Development Agreement comprises a\npreliminary agreement not subject to CEQA insofar as the Intersection Improvements and New\nDrive-Thru are concerned.
