10. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELL GARDENS\nAPPROVING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF\nBELL GARDENS AND BLUE STRIKE ENVIRONMENTAL, INC. FOR THE PREPARATION\nOF A CLIMATE ACTION PLAN\nA resolution to approve a professional service agreement between Blue Strike Environmental, Inc.\nfor consultation on the preparation of the Bell Gardens Climate Action Plan.\nRecommendation:\nIt is staff’s recommendation that the City Council adopt the attached Resolution approving a\nProfessional Services Agreement with Blue Strike Environmental, Inc. for the preparation of the\nBell Gardens Climate Action.

11. JOINT TAX TRANSFER RESOLUTION ARTESIA CEMETERY DISTRICT, DOWNEY\nCEMETERY DISTRICT, AND LITTLE LAKE CEMETERY DISTRICT REORGANIZATION\nNO. 2021-03\nThree public cemeteries (Artesia Cemetery District, Downey Cemetery District, and Little Lake\nCemetery District) have undertaken a reorganization to better serve the community and rectify map\ndeficiencies. This reorganization will result in more logical boundaries for all three cemeteries that\nwill align with existing city boundaries. Approval would put Bell Gardens residents within the\nboundaries of the Downey Cemetery District and would afford all Bell Gardens residents with the\n“in district” rate for burials at the Downey Cemetery District.\nRecommendation:\nIt is staff's recommendation that the City Council adopt a Joint Tax Transfer Resolution for Artesia\nCemetery District, Downey Cemetery District and Little Lake Cemetery District Reorganization No.\n2021-03.

12. CONSIDERATION OF A RESOLUTION APPROVING A WATER RIGHT LICENSE AND\nAGREEMENT WITH LIBERTY UTILITIES (PARK WATER) CORP. GRANTING A LICENSE\nTO EXTRACT 500 ACRE-FEET OF CITY’S GROUNDWATER PUMPING ALLOCATION\nRIGHTS FOR FY 2023-2024\nConsideration of a Resolution approving a Water Right License and Agreement with Liberty\nUtilities (Park Water) Corp. granting a license to extract 500 acre-feet of the City’s unused\ngroundwater pumping allocation rights for fiscal year 2023-2024.\nRecommendation:\nIt is staff's recommendation that the City Council adopt the attached Resolution approving a Water\nRight License and Agreement with Liberty Utilities (Park Water) Corp. granting a license to extract\n500 acre-feet of the City’s unused groundwater pumping allocation rights for fiscal year 2023-2024,\nfor a total fee of $25,000.

ACCEPTANCE OF SLURRY SEAL ZONE 4 (CIP NO. 3921) PROJECT AS COMPLETE\nConsideration of acceptance of the Slurry Seal Improvement Zone 4 as complete.\nRecommendation:\n5\nIt is staff's recommendation that the City Council:\n1. Accept the Slurry Seal Improvement Zone 4 (CIP No. 3921) as complete; and\n2. Authorize staff to file the Notice of Completion.

APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO SOLICIT\nBIDS FOR THE FORD PARK MAINTENANCE YARD ACCESS ROAD PROJECT (CIP NO.\n3902)\nThe plans and specifications for the Ford Park Maintenance Yard Access Road Project have been\nprepared. Approval of this item will allow the City to advertise the project for bids.\nRecommendation:\nIt is staff's recommendation that the City Council:\n1. Approve the plans and specifications for the Ford Park Maintenance Yard Access Road Project;\n2. Authorize staff to solicit competitive bids and publish the Notice Inviting Sealed Bids (NISB);\nand\n3. Find that the project is categorically exempt from the California Environmental Quality Act\n(CEQA) pursuant to Guidelines Section 15301(c).

CONSIDERATION OF A RESOLUTION APPROVING TRANSFER AGREEMENT NO.\n2024MP08 WITH THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT FOR THE\nSAFE, CLEAN WATER PROGRAM – MUNICIPAL PROGRAM\nConsideration of a Resolution approving a transfer agreement with Los Angeles County Flood\nControl District for the Safe, Clean Water– Municipal Program.\nRecommendation:\nIt is staff's recommendation that the City Council adopt the attached Resolution approving Transfer\nAgreement No. 2024MP08 with the Los Angeles County Flood Control District for the Safe, Clean\nWater Program - Municipal Program.

APPROVAL OF SUBRECIPIENT AGREEMENT WITH COUNTY OF LOS ANGELES FOR\n2021 STATE HOMELAND SECURITY PROGRAM\nThe City has been awarded $72,000 for the 2021 State Homeland Security Program grant funding.\nIf the subrecipient agreement is approved, staff will come at a later to Council for approval of the\nproposed purchases allowed under this grant.\nRecommendation:\nIt is staff’s recommendation that the City Council adopt the attached Resolution approving the\nState Homeland Security Program Subrecipient Agreement Grant Year 2021 between the County\nof Los Angeles and the City of Bell Gardens thereby accepting the 2021 State Homeland Security\nProgram (SHSP) grant funds.

FOR LANDSCAPE MAINTENANCE\nSERVICES AT FORD PARK\nA First Amendment to the Contract Services Agreement with BrightView Landscape Services, Inc.\nfor landscape services at Ford Park.\nRecommendation:\nIt is staff's recommendation that the City Council adopt the attached Resolution authorizing the City\nManager to execute a First Amendment to the Contract Services Agreement with Brightview\nLandscape Services, Inc. approving a CPI adjustment of 3.9% and exercising the right to extend\nthe Term of the Contract Services Agreement to June 1, 2025.\n6

19. LOCAL COMMISSIONS APPOINTMENT LIST\nThe Local Commissions Appointments List outlines the City of Bell Gardens Commissions and\nCommissioners. Per the Bell Gardens Municipal Code, City Commissions consist of Bell\nGardens residents appointed by each member of the City Council. Council Members may remove\ncommissioners during any regular City Council meeting and may appoint commissioners following\n10 working days after the posting of the vacancy notice.\nRecommendation:\nIt is staff's recommendation that the City Council review the Commissions Appointments List and\nby motion, remove commissioners and/or make appointments to the posted vacancies.

CONSIDERATION OF GENERAL PLAN AMENDMENT NO. 2022-060 TO ADD AN\nENVIRONMENTAL JUSTICE ELEMENT TO THE BELL GARDENS GENERAL PLAN\nConsideration and approval of a general plan amendment to add a new Environmental Justice\nElement to the Bell Gardens General Plan consistent with State Law.\n2\nRecommendation:\nIt is staff’s recommendation that the City Council:\n1. Find pursuant to California Environmental Quality Act (CEQA) (Pub. Res. Code § 21000 et\nseq.) and CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) Section 15074, after\nconsideration of the whole administrative record, including the Initial Study/Negative\nDeclaration (IS/ND), and all comments received, there is no substantial evidence that the\nproject will not have a significant effect on the environment and adopt IS/ND(SCH#\n2024040433); and\n2. Adopt the attached resolution to approve General Plan Amendment 2022-060 to add an\nEnvironmental Justice (EJ) Element to the Bell Gardens General Plan.

GENERAL MOTION TO WAIVE FULL READING AND APPROVE ORDINANCES BY\nTITLE ONLY PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 36934\nIn order to expedite the conduct of business at City Council meetings, California State Law\n(California Government Code Section 36934) allows Ordinances to be read by title if a majority of\nthe legislative body supports the motion to waive the full reading.\nRecommendation:\nIt is staff's recommendation that the City Council approve a general motion to waive full reading and\napprove Ordinances by title only pursuant to California Government Code Section 36934.

WARRANT REGISTERS AND WIRE TRANSFERS\nIn approving the action of receiving and filing the warrant registers, the official minutes of the Bell\nGardens City Council should state that each individual member of the City Council is not voting on,\ninfluencing the outcome of, or participating in approving, accepting, receiving or filing any warrant\nwhich bears the name of the same council member, or pays for any costs or expenses, or\notherwise benefits the same named council member. Each council member will not be participating,\ninfluencing or voting on any such warrant bearing their name or which benefits the same named\ncouncil member, but with that exception is voting in favor of receiving and filing all other warrants\ncontained in this report, unless otherwise noted on the record at the time of the approval of the\naction required by this report.\nRecommendation:\nIt is staff's recommendation that the City Council receive and file the warrant registers, wire\ntransfers, and net payrolls dated 06/13/2024, 06/18/2024, and 06/25/2024.
