Approve and authorize the City Manager to execute future individual\nDesign-Build Contract Change Orders not exceeding the Contingency\namount for the Downtown Parking Structure Project (DE-24-132-SQ-01).\n3. A. Adopt Ordinance No. 1967, Amending Chapters 16, 17, and 25-0094\n19 of the Fontana Municipal Code to make sections more\nintuitive and to incorporate current best practices.\n1. Read by title only and waive the further reading of section 16-17 to allow\nthe sale and consumption of beer and alcohol incidental to the purpose of\na permit obtained for a designated area in a public park under sections 17\n-5 and 19-3 of the FMC with approvals, including that of the city manager,\nas it pertains to tourism, community, and cultural events.\n2. Read by title only and waive the further reading of section 17-5 to amend\nthe requirements and timeframes for permits for meetings, assemblies,\nrallies, demonstrations and parades consisting of 50 or more individuals\non a public street, sidewalk or other public place within the city to grant\nthe City an appropriate amount of time to receive and review applications\nand to include additional methods of service for applicants to receive\nnotice of the City’s decision on such applications.\n3. Read by title only and waive the further reading of Chapter 19, sections\n19-1, 19-2, 19-3, and 19-35 to update references to the Parks,\nCommunity and Human Service Commission; prohibit any tournament or\nthe charge of admission fees or associated fees in any publicly\nmaintained park; increase the threshold of the number of people required\nfor a permit under the chapter; amend the reservation procedure to\nprovide an indemnity provision and to increase the timeframes for\nreservation requests for permits under the chapter; amend the conditions\nfor denial to further clarify such conditions for permits under the chapter;\nand to update the duties of the parks, community and human services\ncommission to bring the municipal code current.

Determine that the proposed ordinance is statutorily exempt from the\nCalifornia Environmental Quality Act (“CEQA”) pursuant to California\nPublic Resources Code section 21080.17 as CEQA does not apply to the\nadoption of an ordinance by a city or county implementing the provisions\nof Article 2 of Chapter 13 of Division 1 of Title 7 of the California\nGovernment Code, Which is California’s ADU law and which also\nregulates JADUs, as defined by section 66313; and,\n2. Read by title only and waive further reading of and introduce Ordinance\nNo.1966, an Ordinance of the City of Council of the City of Fontana\napproving Master Case No. 24-073 and Municipal Code Amendment\n(MCA) No. 24-006 to amend Section 30-467 of Chapter 30 of the\nMunicipal Code pertaining to accessory dwelling units (ADUs) and junior\naccessory dwelling units (JADUs) to comply with State of California law;\nand the reading of the title constitutes the first thereof.
