FOR CONSTRUCTION MANAGEMENT\nSERVICES FOR THE CITYWIDE TRAFFIC SIGNAL COORDINATION\nAND SIGNAL HEAD UPGRADES (CIP NO. 21112)\nRequested Action: That the City Council approve the Agreement between the City\nof Jurupa Valley and STC Traffic, Inc. of Carlsbad, California (Consultant) for\nConstruction Management and Construction Inspections (CM/CI) Services in the\namount of $263,630 for the Citywide Traffic Signal Coordination and Signal Head\nUpgrades (CIP No. 21112) and $132,200 for signal timing services for a not-to-\nexceed amount of $395,830.

G. AWARD CONSTRUCTION CONTRACT TO CROSSTOWN\nELECTRICAL & DATA, INC. FOR THE CITYWIDE TRAFFIC SIGNAL\nCOORDINATION AND SIGNAL HEAD UPGRADES (CIP NO. 21112)\n1. Requested Action: That the City Council award a construction contract to\nCrosstown Electrical & Data, Inc. in the amount of $1,865,590 for the\nCitywide Traffic Signal Coordination.\n2. Requested Action: That the City Council award a traffic equipment\nprocurement contract to Swarco McCain Inc. in the amount of $421,682.74\nfor the Citywide Traffic Signal Coordination (Equipment).\n2. Authorize the City Manager to execute the agreement in substantially the\nform and format attached to the staff report as approved by the City\nAttorney.

APPROVAL OF TRACT MAP NO. 38171 COUNTRYSIDE ESTATES\nLOCATED EAST OF LIMONITE AVENUE FRONTAGE ROAD AND WEST\nOF RIVERVIEW DRIVE, ACCEPTANCE OF OFFERS OF DEDICATION,\nAPPROVAL OF SUBDIVISION AGREEMENTS, AND ACCEPTANCE OF\nIMPROVEMENT BONDS\n1. Requested Action: That the City Council approve Tract Map 38171 and\naccept the dedication as follows:\na. Accept the real property described as an easement for public street\nand utility purposes for Lot “A” (Saddlehorn Lane) and Lot “B”\n(Riverview Drive).\nb. Accept the real property described as a storm drain easement for\npublic purposes.\nc. Accept the reciprocal access easement for ingress, egress and\nemergency vehicle access.\nd. Accept Lot 32 for infiltration basin, water quality and open space\npurposes.\n2. Authorize the Mayor and City Clerk to sign Tract Map 38171\n3. K. CONSIDERATION AND APPROVAL OF AMENDMENT NO. 1 TO\nCONSULTANT SERVICES AGREEMENT BETWEEN THE CITY OF\nJURUPA VALLEY AND SCOTT FAZEKAS & ASSOCIATES, INC. FOR\nBUILDING OFFICIAL SERVICES\nRequested Action: That the City Council authorize the City Manager to execute\nAmendment No. 1 to the consultant services agreement with Scott Fazekas &\nAssociates, Inc. for Building Official Services in the Community Development\nDepartment.

L. APPROVE AGREEMENT BETWEEN THE CITY OF JURUPA VALLEY\nAND TKE ENGINEERING, INC. FOR CONSTRUCTION MANAGEMENT\nSERVICES FOR THE 2023-2024 PAVEMENT REHABILITATION\nPROJECT (CIP #23105)\n1. Requested Action: That the City Council approve the Agreement between\nthe City of Jurupa Valley and TKE Engineering, Inc. for Construction\nManagement and Inspection Services for a not-to-exceed amount of\n$164,307.00 for the Citywide Paving Rehabilitation Project (CIP #23105);\nand\n2. Authorize the City Manager to execute any subsequent related minor\namendments to the Agreement with TKE Engineering, Inc., up to 10% as\ncontingency to cover the cost of any unforeseen conditions; and\n3. Authorize the Finance Director to make appropriate budgetary adjustments\nas necessary.

M. AWARD CONSTRUCTION AGREEMENT TO HARDY AND HARPER, INC.\nFOR THE 2023-2024 PAVEMENT REHABILITATION PROJECT (CIP\n#23105)\n1. Requested Action: That the City Council award a construction contract to\nHardy and Harper Inc. in the amount of $2,757,000.00 for the Citywide\nPaving Rehabilitation Project.\n2. Approve a project contingency in the amount of $275,700 (10% of bid\namount) for unforeseen conditions.\n3. Allocate funds for the Project in the amount $1,720,936.58 from American\nRescue Plan Act (ARPA), as outlined in the Table A in the financial impact\nsection.\n4. Authorize the City Manager to execute the agreement in substantially the\nform and format attached to the staff report as approved by the City\nAttorney.\n5. Authorize the Finance Director to make any appropriate budgetary changes.

CONFERENCE WITH LEGAL COUNSEL – POTENTIAL LITIGATION.\nThe City Council will meet in closed session with the City Attorney pursuant to\nGovernment Code Section 54956.9(d)(2).(3) with respect to one matter of potential\nlitigation. A point has been reached where, in the opinion of the City Attorney,\nbased on existing facts and circumstances, there is a significant exposure to\nlitigation involving the City with respect to the proposed project at 7586 Jurupa\nRoad based on four letters concerning the Project: 1) October 7, 2024 from Linda\nKlein, attorney for Warmington Residential to Assistant City Attorney Maricela\nMarroquin; 2) November 27, 2024 from Sonja Trauss, Executive Director, YIMBY\nLaw to Planning Commission; 3) December 5, 2024 from , Dylan Casey, Executive\nDirector, and James Lloyd, Director of Planning and Investigations, California\nHousing Defense Fund; and 4) December 11, 2024 from Linda Klein, attorney for\nWarmington Residential to Planning Commission. The four letters are available\nfor public inspection from the Office of the City Clerk.
