Hear a presentation from the City Manager and the City Attorney as to options to\nconsider should the City Council wish to ask the voters to adopt a City Charter in\nNovember 2026; and\n2. Provide direction to staff and make any appropriate recommendations as to next\nsteps.

13.\nADOPTION OF A RESOLUTION UPDATING THE MASTER FEE SCHEDULE\nRecommendations:\n1. Adopt the Resolution titled, “A RESOLUTION OF THE CITY COUNCIL OF\nTHE CITY OF LAGUNA BEACH, CALIFORNIA, ADOPTING ITS MASTER\nFEE SCHEDULE AND FINDING SUCH ACTIONS EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT”; and\n2. Find the action exempt from the California Environmental Quality Act pursuant to\nCEQA Guidelines Sections 15378(b)(4), 15273(a)(1), and 15273(a)(2).\nK.\nPUBLIC HEARINGS FOR APPEALS. This section is specifically for appeals of\ndeterminations of the Planning Commission, the Design Review Board, or other Boards\nor Commissions. Public Hearings (Appeals) are different from other public hearings in\ntwo ways: (1) In some cases, the City Council can only consider whether a lower body\nabused its discretion in granting or denying a project application. In other cases, the\nCouncil can conduct the hearing “de novo,” meaning that it can consider old and new\ninformation and make a determination unbound by the lower body’s decision. The item’s\nstaff report will clearly state which review standard applies to each appeal item; and (2)\npublic comment generally occurs this way: Staff presents a report about the appeal,\nCouncil members ask questions about the report. Then the presiding officer opens the\npublic hearing, inviting the person who filed the appeal (the appellant) to speak first,\nfollowed by persons supporting the appellant’s position. Then the presiding officer\ninvites persons disagreeing with appeal to speak. When all speakers have spoken, the\npresiding officer invites the appellant up a second time to address any comment and to\nconclude their argument. Following that, the presiding officer closes the public hearing,\nand the Council deliberates further and ultimately votes on a motion. The City Council\nconducts all Public Hearings in accordance with the provisions of applicable Laguna\nBeach procedure and State law. The Mayor shall have discretion to establish the time\nallocated for persons who wish to speak, often allowing more time for the appellant\nand/or the applicant.\nL.\nCOUNCIL MEMBER ITEM(S). Adopt the Resolution titled, “A RESOLUTION OF THE CITY COUNCIL OF\nTHE CITY OF LAGUNA BEACH, CALIFORNIA, UPDATING THE CITY’S\nRECORDS RETENTION SCHEDULE, AUTHORIZING DESTRUCTION OF\nCERTAIN CITY RECORDS, AND RESCINDING RESOLUTION NO. 25.006”;\nand\n2. Find the action is not a “project” within the meaning of the California\nEnvironment Quality Act under Public Resources Code Section 21065.

5.\nPUBLIC ART INSTALLATIONS AT GLENNEYRE PARKING STRUCTURE AND\nANITA STREET BEACH ACCESS\nRecommendations:\n1. Approve the installation of the sculpture titled, “A Breeze, Floating Bloom” by\nArne Quinze to satisfy the Art in Public Places requirement in Chapter 1.09 of the\nLaguna Beach Municipal Code for 501 Glenneyre Street (Parking Lot 6);\n2. Approve the expenditure of $130,000 and appropriation of $21,605 from the Art in\nLieu Fund for the installation of the sculpture titled, “A Breeze, Floating Bloom”\nby Arne Quinze;\n3. Approve the installation of the untitled tile mural by Kevin A. Myers at the Anita\nStreet Beach Access Renovation Project;\n4. Approve the expenditure of $30,000 installation of an untitled tile mural by artist\nKevin A. Myers; and\n5. Find that these actions are exempt under California Environmental Quality Act\npursuant to State CEQA Guidelines Section 15303.

6.\nAMENDMENT TO SERVICE PROVIDER AGREEMENT FOR BUILDING AND\nPLANNING SERVICES\nRecommendations:\n1. Authorize the City Manager to execute a third amendment to Agreement #22-64\nwith the Code Group, Inc. (dba VCA Code) to increase the contract amount by\n$190,000 for continued building and planning services; and\n2. Find this action is not a “project” subject to the California Environmental Quality\nAct (CEQA) pursuant to Section 15378 of the CEQA Guidelines.

Authorize the City Manager to execute an Amendment to an Easement Agreement\nrelated to right of way adjacent to 31131 Monterey Street; and\n2. Find the recommended action is not a project within the meaning of the California\nEnvironmental Quality Act under CEQA Guidelines Section 15061(b)(3) based on\nthe reasons in the staff report.

Affirm Council direction to refer the matter to the Environmental Sustainability\nCommittee for review and recommendation regarding potential participation in\nOCPA;\n2. Direct staff to initiate a no-cost feasibility study with OCPA in parallel, and return\nto the City Council with the Committee’s findings and any recommended next\nsteps for formal consideration; and\n3. Find that the recommended action is not subject to the California Environmental\nQuality Act pursuant to Section 15378 of the CEQA Guidelines.
