NOTICE OF COMPLETION – VARIOUS CAPITAL IMPROVEMENT PROJECTS\nIt is recommended that the City Council consider:\n(1) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nSeptember 7, 2023 accepting various sewer projects completed by GRBCON, Inc; and\n(2) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nOctober 5, 2023 accepting the Slurry Seal Project (Year 2) completed by Onyx Paving\nCompany, Inc;\n(3) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nOctober 11, 2023 accepting the Street Rehabilitation at Various Locations Project (Year\n1) completed by All American Asphalt, Inc.;\n(4) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nOctober 11, 2023 accepting the Garfield Ave Traffic Signal Improvements project\ncompleted by PTM General Engineering Services, Inc;\n(5) Taking such additional, related, action that may be desirable.

PREFERENTIAL PARKING DISTRICT: W. 1ST STREET FROM SHERBROOK AVENUE TO\nSCHOOLSIDE AVENUE\nIt is recommended that the City Council consider:\n(1) Opening a public hearing to receive documentary and testimonial evidence;\n(2) After closing the hearing and considering the evidence, adopting a Resolution amending\nResolution Nos. 10931, 11634 and 11744 to include W. 1st Street from Sherbrook Avenue\nto Schoolside Avenue among the preferential parking districts; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe proposed action is exempt from the requirements of the California Environmental Quality\nAct (Pub. Res. Code §§ 21000, et seq.: “CEQA”) and CEQA Guidelines (Cal. Code Regs. Title\n14, §§ 15000, et, seq.) in accordance with CEQA Guidelines § 15305 (Class 5 – Minor Alterations\nin Land Use Limitations). The project involves a negligible expansion of use; there is only a minor\nchange in the operation of an existing use. The project would not result in significant effects\nrelated to traffic, noise, air quality, or water quality and it can be adequately served by all required\nutilities and public services.

5-A. AUTHORIZATION TO ISSUE LEGISLATIVE SUBPOENAS REGARDING THE POTENTIAL\nREVOCATION OF CONDITIONAL USE PERMIT NO. CU-89-004 (AS AMENDED AND\nMODIFIED) HELD BY ATLANTIC SQUARE, LLC.\nIt is recommended that the City Council consider:\n(1) Adopting a Resolution authorizing the Mayor and City Clerk to issue legislative subpoenas\nfor testimony and records related to the potential revocation of CUP No. CU-89-004 (as\namended) that was originally approved via Resolution No. 9356, adopted August 29, 1989\n(and subsequently modified/amended); and\n(2) Taking such additional, related, action that may be desirable.
