ADOPT Resolution No. 2022-XX, attached hereto, DENYING Appeal\nPAA22-0004.\nOR\n1. ADOPT Resolution No. 2022-XX, attached hereto:\n1. ADOPTING the Initial Study/Mitigated Negative Declaration\nprepared for General Plan Amendment (PEN20-0174), Change of\nZone (PEN20-0175); Tentative Tract Map 37858 (PEN20-0172),\nand Conditional Use Permit (PEN20-0173) for a Planned Unit\nDevelopment, on file with the Community Development\nDepartment, incorporated herein by this reference, which was\ncompleted in compliance with CEQA and the CEQA Guidelines,\nand reflects that the Planning Commission and City reviewed and\nconsidered the information contained in the Initial Study/Mitigated\nNegative Declaration, and exercised its independent judgment and\nanalysis of the Proposed Project’s potential environmental impacts;\nand\n2. Conduct the Public Hearing and accept public testimony for the mail ballot\nproceeding for the National Pollutant Discharge Elimination System\n(NPDES) Residential Regulatory Rate to be applied to the property tax bill\nof the parcel identified herein (KB Home Coastal, Inc., located near the\nsouthwest corner of Cottonwood Ave. and Moreno Beach Dr., east of\nBethany Rd.);\n2. Direct the City Clerk to open and count the returned NPDES ballot;\n3. Verify and accept the results of the mail ballot proceeding as maintained\nby the City Clerk on the Official Tally Sheet and if approved, set the rate\nand impose the applicable NPDES Regulatory Rate on the Assessor’s\nParcel Number as mentioned;\n4. Receive and file the Official Tally Sheet with the City Clerk’s office.
