SECOND AMENDMENT WITH VB RUN, LLC, A DELAWARE LIMITED\nLIABILITY COMPANY, FOR EXTENSION OF THE\nTELECOMMUNICATIONS LICENSE AGREEMENT WITH LICENSEE AND\nALLOW LCENSEE TO SUB-LEASE TO NATIONAL BROADBAND\nCARRIERS FOR A SEPARATE REVENUE SHARE PER THE TERMS OF\nTHE AGREEMENT (Report of: Parks & Community Services)\nRecommendations: That the City Council and CSD:\n1. Authorize the City Manager\Executive Director of the Moreno Valley\nCommunity Services District and or it’s designed to execute the\nSecond Amendment to the Telecommunications Lease Agreement\nwith VB RUN, LLC, a Delaware limited liability company, to extend the\nrenewal terms with the Licensee, VB Run LLC, for an additional 5\nyears at the beginning rates of $3,543.93 per month for rent and\n$100.00 per month for the maintenance fee, each to be adjusted\nannually by CPI or 3%, whichever is greater, per the terms of the 2 nd\nAmendment, and;\n2. Allow Licensee to sublicense\sublease to any applicable\nSublicensees\Subtenants, upon written request to the he City of\nMoreno Valley (“City”)/Moreno Valley Community Services District\n(“CSD”) (“Licensor”), in return for a separate revenue share of rents at\na rate of fifty percent (50%) of the rents collected by Licensee payable\nto the City\CSD for use of Improvements at the existing cell facility\nlocated on the property at 15115 Indian Street, Moreno Valley, CA\n92551, known as John F. Kennedy Park; and,\n3. Approve the City Manager\Executive Director of the Moreno Valley\nCommunity Services District and or it’s designed to submit necessary\nbudget adjustments as applicable.

I.7. ACCEPTANCE OF THE TOBACCO LAW ENFORCEMENT GRANT\nPROGRAM AWARD, MEMORANDUM OF UNDERSTANDING AND\nRESOLUTION NO. 2024-XX (Report of: Police Department)\nRecommendations:\n1. Accept the Tobacco Law Enforcement Grant Program grant award in\nthe amount of $123,850 for overtime costs to conduct tobacco\nenforcement operations in Fiscal Years 2025/26 and 2026/27.\n2. Authorize the Chief Financial Officer to appropriate $123,850 as\nrevenue and expense per fiscal year in Fund (2300) beginning in\nFiscal Year 2024/25 and carrying over program budget over the grant\nperiod.\n3. Approve the Memorandum of Understanding between the City of\nMoreno Valley and the Department of Justice regarding the Tobacco\nLaw Enforcement Grant Program award.\n4. Adopt Resolution No. 2024- XX a Resolution of the City Council of the\nCity of Moreno Valley, California, authorizing the City Manager to\nexecute the agreement with the State of California Department of\nJustice.

REVIEW AND CONSIDER THE ART COMMISSION'S APPROVAL OF\nPUBLIC ART REQUEST FOR FUNDING APPLICATION - MARYAM\nCROGMAN MURAL MAIN LIBRARY (Report of: Parks & Community\nServices)\nArt Commission’s Recommendations: That the City Council:\n1. Receive and file the artist presentation; and\n2. Review and consider the Art Commission’s approval of Public Art\nRequest for Funding Application from Maryam Crogman for the\ncreation and installation of a 1,674 square foot mural “MoVal Reads”\nat the Moreno Valley Main Branch Library; and\n3. Authorize Executive Director and or its designee to enter into an\nagreement for services with the approved applicant and submit a\nbudget adjustment request to utilize funding from DIF Public Art Fund\n2916.

Review and consider the Art Commission’s approval of Public Art\nRequest for Funding Application from Patrick Barwinski for the\ninclusion of AR Animation effects on the previously approved 2,835\nsquare foot mural at the Moreno Valley Conference & Recreation\nCenter (CRC); and\n3. Authorize Executive Director and or its designee to enter into an\nagreement for services with the approved applicant and submit a\nbudget adjustment request to utilize funding from DIF Public Art Fund\n2916.
