I.6. SECOND AMENDMENT WITH VB RUN, LLC, A DELAWARE LIMITED\nLIABILITY COMPANY, FOR EXTENSION OF THE\nTELECOMMUNICATIONS LICENSE AGREEMENT WITH LICENSEE AND\nALLOW LCENSEE TO SUB-LEASE TO NATIONAL BROADBAND\nCARRIERS FOR A SEPARATE REVENUE SHARE PER THE TERMS OF\nTHE AGREEMENT (Report of: Parks & Community Services)\nRecommendations: That the City Council and CSD:\n1. Authorize the City Manager\Executive Director of the Moreno Valley\nCommunity Services District and or it’s designed to execute the\nSecond Amendment to the Telecommunications Lease Agreement\nwith VB RUN, LLC, a Delaware limited liability company, to extend the\nrenewal terms with the Licensee, VB Run LLC, for an additional 5\nyears at the beginning rates of $3,543.93 per month for rent and\n$100.00 per month for the maintenance fee, each to be adjusted\nannually by CPI or 3%, whichever is greater, per the terms of the 2 nd\nAmendment, and;\n2. Allow Licensee to sublicense\sublease to any applicable\nSublicensees\Subtenants, upon written request to the he City of\nMoreno Valley (“City”)/Moreno Valley Community Services District\n(“CSD”) (“Licensor”), in return for a separate revenue share of rents at\na rate of fifty percent (50%) of the rents collected by Licensee payable\nto the City\CSD for use of Improvements at the existing cell facility\nlocated on the property at 15115 Indian Street, Moreno Valley, CA\n92551, known as John F. Kennedy Park; and,\n3. Approve the City Manager\Executive Director of the Moreno Valley\nCommunity Services District and or it’s designed to submit necessary\nbudget adjustments as applicable.
