Second Reading to Adopt Ordinance No. 25-07 to Amend Section 10.16.210\n(Commercial Vehicles) of Chapter 16 (Parking and Traffic Control) of Title 10\n(Vehicles and Traffic) of the San Jacinto Municipal Code, Relating to the\nRegulation of Commercial Vehicle Parking and the Establishment of a Limited\nExemption for Historic Commercial Vehicles.\nRECOMMENDATION:\nStaff recommends that the City Council:\n1. Determine that the proposed ordinance is not subject to the California\nEnvironmental Quality Act (CEQA) under Sections 15060(c)(2) and\n15060(c)(3) of the CEQA Guidelines because it will not result in a direct or\nreasonably foreseeable indirect physical change in the environment and does\nnot constitute a “project” as defined by CEQA; further, the ordinance qualifies\nfor the “common sense” exemption under Section 15061(b)(3), as it can be\nseen with certainty that there is no possibility it may have a significant effect\non the environment since it does not authorize new development, grading, or\nconstruction, nor does it modify land use designations, zoning entitlements, or\ndensity, but instead establishes a narrow exemption for a limited number of\nhistoric commercial vehicles on qualifying residential rural parcels along with\nclarifying updates to the definition of “commercial vehicle.”; and,\n2. Conduct a second reading and Adopt Ordinance No. 25-07, entitled:\nAn Ordinance of the City of San Jacinto Amending Section 10.16.210\n(Commercial Vehicles) of Chapter 16 (Parking and Traffic Control) of\nTitle 10 (Vehicles and Traffic) of the San Jacinto Municipal Code,\nRelating to the Regulation of Commercial Vehicle Parking and the\nEstablishment of a Limited Exemption for Historic Commercial\nVehicles.\nDepartment:\nCommunity Development

San Jacinto Power – 2024 Power Source Disclosure Attestation\nRECOMMENDATION:\nStaff recommends that the City Council:\n1) Provide the attestation specified under California’s Power Source Disclosure\n(PSD) Program, which requires the governing council of a public agency\nproviding retail electric service to endorse the accuracy of the annual report, as\nsubmitted to the California Energy Commission, for the previous year. In the\ncase of San Jacinto Power (SJP), such attestation will be based on the California\nChoice Energy Authority’s (CalChoice) Annual Report prepared for the SJP\nCommunity Choice Aggregation (CCA) program.\nDepartment:\nFinance

4.1.\nA Public Hearing to Consider Adopting a Resolution of Necessity to Acquire by\nEminent Domain Permanent Road Easement Interests in Portions of Certain Real\nProperty Located in The City of San Jacinto, County of Riverside, California and\nMore Particularly Described as Assessor Parcel No’s. 439-120-047, 439-130-002,\n140-130-003, 439-140-007, 439-140-008, 439-140-009, 439-140-010, 439-170-014,\n439-170-015 And 439-170-022 for The San Jacinto Street (Avenue) Safety\nImprovement Project\nRECOMMENDATION:\nStaff recommends that the City Council conduct a public hearing and;\n1. Consider adopting a Resolution of Necessity for the San Jacinto Street (Avenue)\nSafety Improvement Project and provide each party with an interest in the\naffected property, their attorneys or representatives an opportunity to be heard on\nthe issues relevant to the Resolution of Necessity;\n2. Make the findings required by California eminent domain law (Code of Civil\nProcedure §§ 1240.030, 1245.230) that:\na. The public interest and necessity require the San Jacinto Avenue Safety\nImprovement Project (“Project”);\nb. The Project is planned and located in the manner that will be most\ncompatible with the greatest public good and least private injury;\nc. The permanent road easement interests to be acquired are necessary for\nthe Project; and\nd. The City has made offers of just compensation to the owners of record,\nconsistent with Government Code § 7267.2. And;\n3. Adopt Resolution No. 4094- A Resolution of Necessity authorizing the\nacquisition, by eminent domain, of permanent road easement interests in portions\nof the real property described as Assessor Parcel Numbers 439-120-047, 439-130002, 439-130-003, 439-140-007, 439-140-008, 439-140-009, 439-140-010, 439170-014, 439-170-015, and 439-170-022 (collectively, the “Properties”) for the\nProject.\nDepartment: City Attorney
