3-J. PAVEMENT MANAGEMENT PROGRAM – AWARD OF PROFESSIONAL SERVICES\nAGREEMENT TO NCE\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a professional services agreement, in a form\napproved by the City Attorney, with Nichols Consulting Engineers, CHTD dba NCE in the\ncontract amount of $98,977 for the Pavement Management Program and asset inventory\nservices;\n(2) Authorizing the Director of Public Works to approve change orders and contingency up to\n$9,900 (10%) of the contract amount, for a total project cost of $108,877; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and\nthe regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). CEQA Guideline § 15061(b)(3) exempts activities that do not have the potential\nfor causing a significant effect on the environment. This activity is purely administrative and\ndoes not contemplate any physical changes to the environment. Accordingly, it is not subject to\nfurther CEQA review.
