4. Development Code Amendment 24­04 (ADU 2024 Legislative Update) p. 22\nRecommendation:\nIt is recommended that the Mayor and City Council of the City of San Bernardino:\n1. Adopt Urgency Ordinance No. MC­1644U of the Mayor and City Council of the City of San\nBernardino, California, approving Development Code Amendment 24­04 amending Chapter\n19.04 (Residential Zones); Section 19.04.030(2)(P) (Residential Zones Specific\nStandards ­ Accessory Dwelling Units) of the City of San Bernardino Development Code\n(SBMC Title 19) in order to update the development standards for Accessory Dwelling Units\nin compliance with recent changes in state law; and finding such action statutorily exempt\nfrom the California Environmental Quality Act under Public Resources Code Section\n21080.17 (Attachment 1 and Attachment 2); and\n2. Introduce for first reading, read by title only, and waive further reading of Ordinance No.\nMC­1645 of the Mayor and City Council of the City of San Bernardino, California, approving\nDevelopment Code Amendment 24­04 amending Chapter 19.04 (Residential\nZones); Section 19.04.030(2)(P) (Residential Zones Specific Standards ­ Accessory Dwelling\nUnits) of the City of San Bernardino Development Code (SBMC Title 19) in order to update\nthe development standards for Accessory Dwelling Units in compliance with recent changes\nin state law; and finding such action statutorily exempt from the California Environmental\nQuality Act under Public Resources Code Section 21080.17 (Attachment 3 and Attachment\n4); and\n3. Schedule the adoption of Ordinance No. MC­1645 to the regularly scheduled meeting of\nthe Mayor and City Council on January 15th, 2025.
