COMPLIANCE REVIEW OF DEVELOPMENT AGREEMENT NO. 2261-AA DATED\nOCTOBER 6, 2021 REGULATING REAL PROPERTY AT 100-200 SOUTH GARFIELD\nAVENUE (THE “PROJECT”)\nIt is recommended that the City Council consider:\n(1) Receiving and filing this report (NOTE: any alterations to the project proposed by Rykadan\n005, LLC must be processed in accordance with applicable law, i.e., the City Council may\nnot “approve” any changes requested by the developer); and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThese actions are exempt from additional review under the California Environmental Quality Act\n(California Public Resources Code §§ 2100, et seq., “CEQA”) and CEQA Guidelines (14\nCalifornia Code of Regulations §§ 15000, et seq.) pursuant to CEQA Guidelines § 15061(b)(3)\nthe common sense exemption that CEQA applies only to projects which have the potential for\ncausing a significant effect on the environment applies to the recommended action. It can be\nseen with certainty that there is no possibility that the proposed action has a significant effect\non the environment.
