COMPLIANCE REVIEW OF DEVELOPMENT AGREEMENT NO. 2261-AA DATED\nOCTOBER 6, 2021 REGULATING REAL PROPERTY AT 100-200 SOUTH GARFIELD\nAVENUE (THE “PROJECT”)\nIt is recommended that the City Council consider:\n(1) Receiving and filing this report (NOTE: any alterations to the project proposed by Rykadan\n005, LLC must be processed in accordance with applicable law, i.e., the City Council may\nnot “approve” any changes requested by the developer); and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThese actions are exempt from additional review under the California Environmental Quality Act\n(California Public Resources Code §§ 2100, et seq., “CEQA”) and CEQA Guidelines (14\nCalifornia Code of Regulations §§ 15000, et seq.) pursuant to CEQA Guidelines § 15061(b)(3)\nthe common sense exemption that CEQA applies only to projects which have the potential for\ncausing a significant effect on the environment applies to the recommended action. It can be\nseen with certainty that there is no possibility that the proposed action has a significant effect\non the environment.

3-A. MINUTES\nIt is recommended that the City Council consider:\n(1) Approving the minutes from the regular meeting of November 6, 2024 and the special\ncommunity meeting of November 19, 2024; and\n(2) Taking such additional, related, action that may be desirable.

3-B. MONTHLY INVESTMENT REPORT – NOVEMBER 2024\nIt is recommended that the City Council consider:\n(1) Receiving and filing the monthly investment report; and\n(2) Taking such additional, related, action that may be desirable.

WAIVE FURTHER READING AND ADOPT ZONE CHANGE (ZA-24-03), AN ORDINANCE\nAMENDING THE ZONING MAP FOR CERTAIN PROPERTIES FOR CONSISTENCY WITH\nTHE GENERAL PLAN, LAND USE AND URBAN DESIGN ELEMENT.\nIt is recommended that the City Council consider:\n(1) Waiving the second reading and adopting the proposed ordinances; and\n(2) Taking such additional, related, action that may be desirable.\n3-D ACCEPTANCE OF SGVMWD GRANT FOR IRRIGATION CONTROL SYSTEMS\nIt is recommended that the City Council consider:\n(1) Accepting and allocating grant funding in the amount of $50,000 from the San Gabriel\nValley Municipal Water District (“SGVMWD”) for Irrigation Control Systems;\n(2) Authorizing the City Manager to execute the Grant Agreement, in a form approved by the\nCity Attorney, with SGVMWD for this grant program;\n(3) Authorizing the Finance Department to appropriate $50,000 in funding from the FY 2024-\n2025 budget; and\n(4) Taking such additional, related, action that may be desirable.

3-E. BRUGGEMEYER LIBRARY HVAC IMPROVEMENTS – AWARD OF CONTRACT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a public works contract substantially similar to\nAttachment No. 3, in a form approved by the City Attorney, with Bon Air, Inc., in the amount\nof $261,847 for the Bruggemeyer Library HVAC Improvements Project;\n(2) Authorizing the Director of Public Works to approve change orders and contingency up to\n$26,185 (10%) of the contract amount, for a total project cost of $288,032; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and\nthe regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). The proposed activity contemplates maintenance, repair, and operation of\nBruggemeyer Library by replacing mechanical equipment which involves no expansion of the\nexisting use.

3-F. CONSIDERATION AND POSSIBLE ACTION TO REINTRODUCE AND WAIVE FIRST\nREADING OF AN ORDINANCE SETTING SPEED LIMITS BASED UPON CERTIFICATION\nOF THE 2017 ENGINEERING AND TRAFFIC SURVEY FOR SPEED LIMITS EFFECTIVE\nTHROUGH OCTOBER 2031 AND THE 2024 ENGINEERING AND TRAFFIC SURVEY OF 26\nLOCATIONS FOR SPEED LIMITS THROUGH OCTOBER 2038\nIt is recommended that the City Council consider:\n(1) Reintroducing and waiving first reading for an Ordinance setting speed limits throughout\nthe City; and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThis Ordinance is exempt from review under the California Environmental Quality Act (California\nPublic Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder\n(14 California Code of Regulations §§ 15000, et seq., the “CEQA Guidelines”) because it consists\nonly of minor revisions and clarifications to an existing code of speed control regulations\nestablished in accordance with California law and will not have the effect of deleting or\nsubstantially changing any regulatory standards or findings. This Ordinance, therefore, is an\naction being taken for enhanced protection of the environment and that does not have the\npotential to cause significant effects on the environment. Consequently, it is categorically exempt\nin accordance with CEQA Guidelines §§ 15301 as a minor alteration of existing public or private\nstructures involving no expansion of use; 15305 as a minor alteration in land use limitations\nwhich do not result in any changes in land use or density; and 15308 as an action taken by a\nregulatory agency as authorized by California law to assure maintenance or protection of the\nenvironment.

3-G. AMENDMENT TO AGREEMENT 2428-AA WITH U.S. BUILDERS AND CONSULTANTS, INC.\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute the First Amendment, in a form approved by the\nCity Attorney, to Agreement No. 2428-AA with U.S. Builders and Consultants, Inc., to\ncomplete additional restroom renovation work at the Langley Senior Center in the amount\nof $80,495 including labor and 15% contingency;\n(2) Approving an appropriation of $80,495 from CDBG Fund – 362 to the FY 24-25 budget;\nand\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and\nthe regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). CEQA Guideline § 15301(c) (Existing Facilities) exempts the operation, repair,\nmaintenance, alteration of existing public or private structures which involve negligible or no\nexpansion of existing or former use. The proposed work will occur entirely within an existing\nstructure. Accordingly, no further environmental review is required.

5-A. ADOPT AN ORDINANCE ESTABLISHING A BUSINESS LICENSE TAX SCHEDULE\nIt is recommended that the City Council consider:\n(1) Adopt an urgency ordinance establishing a business license tax schedule;\n(2) Introduce and waive first reading of an ordinance establishing a business license tax\nschedule;\n(3) Approve a one-time extension for renewal of business license tax, due and payable by\nApril 1, 2025; and\n(4) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThese actions are exempt from review under the California Environmental Quality Act (California\nPublic Resources Code §§ 2100, et seq., “CEQA”) and CEQA regulations (14 California Code of\nRegulations §§ 15000, et seq.) because they establish rules and procedures to implement\ngovernment funding mechanisms; do not involve any commitment to a specific project which\ncould result in a potentially significant physical impact on the environment; and constitute an\norganizational or administrative activity that will not result in direct or indirect physical changes\nin the environment. Accordingly, neither of the propositions constitute a “project” that requires\nenvironmental review (see specifically 14 CCR § 15378(b)(4-5)).

AMENDMENT TO MONTEREY PARK MUNICIPAL CODE CHAPTER 2.32 UPDATING\nEMPLOYEE RELATIONS\nIt is recommended that the City Council consider:\n(1) Introducing and waiving first reading of an ordinance amending Chapter 2.32 of the\nMonterey Park Municipal Code (“MPMC”) revising Employee Relations procedures; and\n(2) Taking such additional, related, action that may be desirable.

5-C. EMERGENCY REPLACEMENT OF THE FIRE DEPARTMENT SELF-CONTAINED\nBREATHING APPARATUS (SCBAS) – ADOPT A RESOLUTION AUTHORIZING THE CITY\nMANAGER TO EXECUTE NECESSARY AGREEMENTS, WITHOUT THE NEED FOR\nCOMPETITIVE BIDDING TO PURCHASE THE SCBA REPLACEMENTS\nIt is recommended that the City Council consider:\n(1) Adopt a resolution ratifying the City Manager’s proclamation of local emergency dated\nDecember 11, 2024 concerning the replacement of Fire Department Self-Contained\nBreathing Apparatus (“SCBAs”) and authorizing the City Manager to execute necessary\nAgreements, without the need for competitive bidding to purchase the SCBA\nreplacements;\n(2) Appropriating $635,000 to the FY 2024-2025 Budget from the General Fund for the project;\nand\n(3) Taking such additional, related, action that may be desirable.

5-D. AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT WITH\nMONTEREY PARK WOMAN’S CLUB\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager, or designee, to execute a license agreement, in a form\napproved by the City Attorney with the Monterey Park Woman’s Club to utilize the space\nwithin the Service Club House; or\n(2) Taking no action, keeping the current facility reservation fees; and\n(3) Taking such additional, related, action that may be desirable.
