F. ORDINANCE NO. 718: AMENDING TITLE XI (BUSINESS REGULATIONS) TO\nADD CHAPTER 127 OF THE SAN GABRIEL MUNICIPAL CODE RELATING TO\nSIDEWALK VENDING AND AMENDING TITLE VII (TRAFFIC CODE) TO\nAMEND SECTION 72.012 RELATING TO PARKING BY PEDDLERS AND\nVENDORS (CA25-001) – SECOND READING AND ADOPTION\nIn 2018 and 2022, the State passed Senate Bills 946 and 972, respectively,\nlegalizing sidewalk vending with limited government regulations. Government\nCode Sections 51038 and 51039 prohibit cities and counties from adopting\nregulations that restrict the number of overall vendors from certain consents\nand approvals, and restrict the location for sidewalk vending. Cities may only\nadopt restrictions if such activities are found to include health, safety, or welfare\nconcerns. The proposed Code Amendment (CA) would add Chapter 127 of the\nSan Gabriel Municipal Code (SGMC) relating to sidewalk vending and amend\nSGMC Section 72.012 relating to parking by peddlers and vendors. The\nOrdinance would become effective 30 days after adoption. The Fiscal Year 2024-2025\nAdopted Budget includes the cost for required legal publication (Account No. 121-\n702-00-65-000) and codification (Account No. 121-702-00-22-000) of the ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed Code\nAmendment is categorically exempt from the California Environmental Quality\nAct (CEQA) pursuant to Section 15061(b)(3) because it is covered by the\ncommonsense exemption, where it can be seen with certainty that there is no\npossibility that the proposed amendment would have a significant effect on the\nenvironment, therefore it is not subject to CEQA.\nRecommended Action:\nStaff recommends that the City Council waive reading and adopt Ordinance No.\n718 entitled, “An Ordinance of the City Council of the City of San Gabriel,\nCalifornia, adding Title XI (Business Regulations) Chapter 127 (Sidewalk\nVending) Relating to Sidewalk Vending and Amending Title VII (Traffic Code),\nChapter 72 (Stopping, Standing, and Parking), Section 72.012 Relating to\nParking by Peddlers and Vendors.”
