3. SECTION 1.4, “Compensation” is amended to include the following to read as follows:\nSECTION 1.4. COMPENSATION.\nCity hereby agrees to pay Consultant a sum not to exceed THREE HUNDRED\nONE THOUSAND EIGHT HUNDRED NINETY SIX DOLLARS ($301,896) (the\n“Annual Not-to-Exceed Sum”) notwithstanding any contrary indications that may be\ncontained in Consultant’s proposal, for the Services to be performed and reimbursable\ncosts incurred under this Agreement for the time period from July 1, 2024, to June 30,\n2025. Consultant shall be paid at the same hourly rates currently paid by the City. This\nAnnual Not-to-Exceed Sum is merely a maximum budgeted sum authorized by the City,\nand the actual amount of compensation will be based upon the amount of hours worked at\nthe current hourly rates (along with reimbursable costs). Consultant shall submit all\ninvoices to City in the manner specified herein. Except as specifically authorized in\n35\nadvance by City, Consultant shall not bill City for duplicate services performed by more\nthan one person.
