5. CONSIDERATION OF AN ORDINANCE OF THE ALHAMBRA CITY COUNCIL\nAMENDING CHAPTERS 3.36, 3.38, AND 3.40 CONCERNING BIDDING AND\nCONTRACTING THRESHOLDS DUE TO AMENDMENTS TO CUPCCAA, AND\nSECTION 9.74.060 CONCERNING FALSE ALARMS – F2M25-16, O2M25-4845\nPeriodically amendments are needed to the Alhambra Municipal Code (“AMC”) based\nupon changes in legislation and issues arising in implementation of the AMC. This\nordinance makes amendments to the AMC in two areas. Last Fall the City Council adopted\nOrdinance No. O2M24-4837 which implements the California Uniform Public Construction\nCost Accounting Act (“CUPCCAA”), allowing for more expedited contracting for public\nworks projects. That same ordinance also adjusted the various bidding thresholds\nthroughout the AMC for other types of contracts to make the thresholds uniform across\ncontracts. AB 2192, which went into effect January 1, 2025, increases some of the\nCUPCCAA thresholds: the $60,000 threshold is raised to $75,000 and the $200,000\nthreshold is raised to $220,000. An adjustment to these thresholds is necessary to come\ninto compliance with CUPCCAA. Additionally, changes to similar thresholds for other\ncontracts is recommended for consistency, in the same manner that was recommended\nwhen Ordinance No. O2M24-2837 was originally adopted. The second recommended\narea for amendment to the AMC relates to false alarm fees. Under the AMC, after 3 false\nhome alarms within a year, fees are charged for additional responses. The code provides\nthat the Police Chief, may waive those fees. This level of discretion is called out elsewhere\nin the code, but typically the City Council has reserved such discretion to itself. City staff\nwould recommend deleting the provision providing such discretion to City staff.\nRecommended Action: City Council consider introducing for first reading Ordinance\nNo O2M25-4845: An Ordinance of the Alhambra City Council amending Chapters 3.36, 3.38,\nand 3.40 concerning bidding and contracting thresholds due to amendments to CUPCCAA,\nand Section 9.74.060 concerning false alarms\nwhich the Ordinance will return at the next regular meeting for consideration and adoption by\nthe City Council.\nCONSENT AGENDA (Item Nos. 6 – 21)\nAll items listed under the Consent Agenda are considered by the City Council to be routine and\nwill be enacted by one motion unless a citizen or Council member requests otherwise; in which\ncase, the item will be removed for separate consideration.
