3. PUBLIC HEARING TO ADOPT AN ORDINANCE APPROVING ZONING TEXT\nAMENDMENT AMD-24-02 MAKING GENERAL CLARIFYING UPDATES TO THE\nCITY’S ZONING CODE AND ZONING MAP AMENDMENT AMD-25-01 AMENDING THE\nCITY’S ZONING MAP; ADOPT A RESOLUTION APPROVING GENERAL PLAN MAP\nAMENDMENT AMD-25-02 AMENDING THE GENERAL PLAN LAND USE MAP; AND\nDETERMINE THIS ACTION IS EXEMPT FROM CEQA – F2M20-24, N2M25-39, O2M25-\n4844, R2M25-18\nThis is the time and place set by Notice No. N2M25-39 for the City Council to hold a public\nhearing to consider a City-initiated application for a Zoning Text Amendment AMD-24-02\namending various sections of the Alhambra Municipal Code on zoning and adding various\nsections to the Municipal Code to address new State legislation, eliminate inconsistencies,\nclarify ambiguous provisions, correct typographical and formatting errors, and modify use\nallowances. A Zoning Map Amendment AMD-25-01 and General Plan Map Amendment\nAMD-25-02 are also requested to amend the City of Alhambra Official Zoning Map and\nGeneral Plan Land Use Map, respectively, to address inconsistencies, mapping errors,\nand prior recommendations of the Planning Commission. This Zoning Code clean-up\nincludes both proposed amendments and additions.\nProposed amendments consist of revisions to existing sections of the Alhambra Municipal\nCode (AMC), while the proposed additions would incorporate entirely new sections into\nthe AMC. The nature of and reasoning for each proposed amendment and addition can\nbe classified by five general categories: 1.) Clarification; 2.) Consistency; 3.) Compliance\nwith State laws/Federal laws; 4.) Typographical & Formatting; and 5.) Use Allowances &\nRegulations. Some of the proposed amendments and additions are a combination of these\nfive categories. For example, the section on Accessory Dwelling Units is proposed to be\namended to comply with State law, clarify applicable development standards, and impose\nnew regulations pertaining to the Accessory Dwelling Unit uses. Similarly, the addition of\na new section identifying specific standards for Firearms Sales uses will impose new use\nregulations and will be consistent with Urgency Ordinance No. O2M23-4818, which\ndirected staff to provide the City Council with options for additional regulations for such\nuses. In Attachment 1 of the staff report for this item, each proposed amendment and\naddition is briefly described in a table, which includes a breakdown of the categories\napplicable to each amendment or addition.\nAt their March 17, 2025 regular meeting, the Planning Commission reviewed the proposed\namendments and additions in Ordinance No. O2M25-4844 and Resolution No. R2M25-\n18, and adopted Planning Commission Resolution No. 25-02 (Attachment 5 of the staff\nreport) by a vote of 9-0 (Commissioner Mojarro was absent), recommending the City\nCouncil approve Zoning Text Amendment AMD-24-02, Zoning Map Amendment AMD-25-\n01, and General Plan Map Amendment AMD-25-02, with four minor revisions to the\nZoning Text Amendment. The minor revisions recommended by the Planning Commission\nare listed in Planning Commission Resolution No. 25-02 and have been incorporated into\nOrdinance No. O2M25-4844.\nThe City reviewed the environmental impacts of this Ordinance and City Council\nResolution under the California Environmental Quality Act (Public Resources Code §§\n21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of\nRegs. §§ 15000, et seq., the “CEQA Guidelines”). This Ordinance and City Council\nResolution is not subject to further review environmental review because: (1) it will not\nresult in a direct or reasonably foreseeable indirect physical change in the environment\n(14 Cal. Code Regs. § 15060(c)(2); (2) there is no possibility that this Ordinance or City\nCouncil Resolution will have a significant effect on the environment (14 Cal. Code Regs.\n§ 15061(b)(3)); and (3) the Ordinance and City Council Resolution, by itself, do not\nconstitute a “project” as defined in section 21065 of the Public Resources Code and the\nCEQA Guidelines (14 Cal. Code Regs. § 15378). It can be seen with certainty that there\nis no possibility that this Ordinance and City Council Resolution may have a significant\neffect on the environment.\nRecommended Action: City Council:\n1. Conduct a public hearing to receive public testimony;\n2. Determine which of the Planning Commission’s recommendations to include and\ndirect the City Attorney to introduce and give first reading by title only, waiving\nfurther reading to the following ordinance entitled:\nOrdinance No. O2M25-4844: AN ORDINANCE OF THE CITY COUNCIL OF THE\nCITY OF ALHAMBRA ADOPTING ZONING TEXT AMENDMENT AMD-24-02,\nAMENDING THE ALHAMBRA MUNICIPAL CODE TO ADDRESS NEW STATE\nLAWS, ELIMINATE INCONSISTENCIES, CLARIFY AMBIGUOUS PROVISIONS,\nCORRECT TYPOGRAPHICAL AND FORMATTING ERRORS, AND MODIFY USE\nALLOWANCES, AND ZONING MAP AMENDMENT AMD-25-01, AN AMENDMENT\nTO THE CITY OF ALHAMBRA OFFICIAL ZONING MAP\nwhich ordinance shall return for a second reading and adoption at the next City\nCouncil meeting on April 28, 2025;\n3. Adopt Resolution No. R2M25-18 entitled: A RESOLUTION OF THE CITY COUNCIL\nOF THE CITY OF ALHAMBRA, CALIFORNIA APPROVING GENERAL PLAN MAP\nAMENDMENT AMD-25-02, AN AMENDMENT TO THE CITY OF ALHAMBRA\nGENERAL PLAN LAND USE MAP\nPRESENTATIONS
