1. PUBLIC HEARING CITY OF ADELANTO LANDSCAPE MAINTENANCE\nASSESSMENT DISTRICT NO. 1, ANNEXATION OF BELLFLOWER-TRACT 20675\n(2024-033)CALIFORNIA ENVIRONMENTAL QUALITY ACT. (KAVOUSE/RICHARD)\nRECOMMENDATION: Staff recommends that the City Council take the next and final steps to\ncomplete the annexation process for Tract 20675.\nIt is requested that the City Council open the Public Hearing regarding the annexation of Tract\n20675 to the District and the proposed assessments in order to accept public testimony and any\nwritten protests regarding these proceedings. Upon conclusion of the public testimony, the Mayor\nwill close the Public Hearing and direct the City Clerk or their designee to open and tabulate the\nballots received, which may take a few minutes. Upon completion of the tabulation, the City\nClerk will present to the City Council the results of that tabulation which will be in the form of\ntotal dollars ($) in support of the assessments (“Yes” votes) and the total dollars ($) opposed to\nthe assessments (“No” votes); and as a matter of procedure, the City Council would then adopt the\nfirst of two resolutions which formally declares the results of the protest ballot proceedings.\nBased on the weighted ballot tabulation results, if the “No” votes exceed the “Yes” votes then\nthere is a majority protest of the proposed assessments, and the City Council will abandon any\nfurther proceedings at this time to annex this Annexation Territory to the District or to levy the\nannual assessments. If majority protest does not exist, it is requested that the City Council adopt\nthe second resolution which formally annexes Tract 20675 to the District, confirms the\n5\nApril 23, 2025\nAssessment Diagram and assessments outlined in the Engineer’s Report, and orders the levy and\ncollection of the assessments for the Annexation Territory to be collected on the County tax rolls\nfor Fiscal Year 2025/2026 as identified in the Engineer’s Report.\n1.) CONDUCT THE PUBLIC HEARING REGARDING THE ANNEXATION OF TRACT\n20675 TO LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 1.\n2.) AFTER RECEIVING ALL TESTIMONY, CLOSE THE PUBLIC HEARING AND\nDIRECT CITY CLERK OR THEIR DESIGNEE TO TABULATE THE BALLOTS\nRETURNED.\n3.) UPON COMPLETION OF THE BALLOT TABULATION ADOPT THE FOLLOWING\nRESOLUTION.\nRESOLUTION NO.25-15\nDECLARING THE RESULTS OF THE PROPERTY OWNER PROTEST BALLOT\nPROCEEDING CONDUCTED FOR THE LEVY OF ASSESSMENTS RELATED TO THE\nANNEXATION OF BELLFLOWER-TRACT 20675 TO THE ADELANTO LANDSCAPE\nMAINTENANCE ASSESSMENT DISTRICT NO. 1, COMMENCING IN FISCAL YEAR\n2025/2026.\n4.) IF MAJORITY PROTEST DOES NOT EXIST, ADOPT THE FOLLOWING\nRESOLUTION (Otherwise no further action is required).\nRESOLUTION NO. 25-16\nCONFIRMING THE ANNEXATION OF PARCELS WITHIN BELLFLOWER-TRACT 20675\nTO THE ADELANTO LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 1,\nTHE DIAGRAM AND ASSESSMENTS RELATED THERETO, OVERRULING ALL\nPROTESTS CONCERNING THE ASSESSMENTS, AND ORDERING THE LEVY AND\nCOLLECTION OF ASSESSMENTS FOR FISCAL YEAR 2025/2026.
