10D. CONSIDERATION OF A RESOLUTION AWARDING AN EMERGENCY\nCONSTRUCTION CONTRACT TO ALLIANCE DIVERSIFIED ENTERPRISES\nINC. FOR THE INSTALLATION OF CAISSONS AND TIEBACKS FOR THE\nMARQUITA SLOPE INTERIM RECONSTRUCT, CIP PROJECT NO. 21208, IN\nAN AMOUNT NOT TO EXCEED $2,292,421, APPROVING A SUPPLEMENTAL\nAPPROPRIATION IN THE AMOUNT OF $605,996, AUTHORIZING THE CITY\nMANAGER TO EXECUTE THE CONSTRUCTION CONTRACT, AND FINDING\nTHE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-74, which will:\n1. Make a finding that an emergency exists due to the potential failure of an\nexisting sewer pump station and that the situation requires immediate\naction to prevent or mitigate impairment to property and public services,\nthat might otherwise occur if required to incur delays attributed to the\ntypical engineering design and public competitive bidding process. The\nCity Manager has the authority to approve emergency contracts and\npurchases when there is a need to protect public health and safety per\nSection 3.40.070 of the City of San Clemente Municipal Code.\n2. Declare that the public interest and necessity demand the immediate\nexpenditure of public funds to safeguard public health.\n3. Find the Marquita Slope Interim Reconstruct, CIP Project 21208,\ncategorically exempt from the California Environmental Quality Act\n(CEQA) under Class 1 Section 15301(b) of the State CEQA Guidelines.\n4. Approve a supplemental appropriation in the amount of $605,996 to the\nproject Account No. 054-476-43470-000-21208 from the Sewer Fund\nDepreciation Reserve.\n5. Authorize the City Manager to execute, Contract No. C25-16, an\nemergency contract, by and between the City of San Clemente and\nAlliance Diversified Enterprises, Inc., providing for the Marquita Slope\nInterim Reconstruct, in an amount not to exceed $2,292,421.\n6. Authorize the City Manager or designee to approve total project overages\nnot to exceed 10 percent of the construction costs.
