C.5.\nPUBLIC HEARING AND FIRST READING OF ORDINANCE NO. 25____ MODIFYING THE BASIS AND METHOD OF LEVYING\nASSESSMENTS\nWITHIN\nTHE\nSUNSET\nSTRIP\nBUSINESS\nIMPROVEMENT DISTRICT BY ESTABLISHING A PROCEDURE FOR\nWAIVER OF PENALTIES AND/OR INTEREST ON DELINQUENT\nASSESSMENTS AND CODIFYING THE SUNSET STRIP BUSINESS\nIMPROVEMENT DISTRICT REGULATIONS INTO THE WEST\nHOLLYWOOD MUNICIPAL CODE AND MAKING FINDINGS UNDER\nCEQA [L. LANGER]:\nSUBJECT: The City Council will hold a public hearing to consider the\nproposed modification to the assessment method and conduct the first\nreading by title only of Ordinance No. 25-___, which modifies the basis\nand method of levying assessments within the Sunset Strip Business\nImprovement District (BID) by establishing a procedure for waivers of\npenalties and interest on delinquent assessments and codifies the\nDistrict’s regulations, previously established through uncodified Ordinance\nNos. 02-621, 02-632, and 04-679, into a new West Hollywood Municipal\nCode Chapter 5.129. Following the first reading, staff recommends\nscheduling a second reading and adoption at a future City Council\nmeeting. It is recommended that the City Council proceed with these\nactions to finalize the proposed modifications and to codify the regulations.\nRECOMMENDATIONS: 1) Hold a public hearing to consider the proposed\nmodification to the assessment method, evaluating all testimony and\nwritten protests to determine if a majority protest exists; and 2) If no\nmajority protest is found, conduct the first reading of Ordinance No. 25____ by title only, modifying the method of levying assessments within the\nSunset Strip Business Improvement District by establishing a procedure\nfor waiver of penalties and interest on delinquent assessments and\ncodifying the Sunset Strip Business Improvement District regulations into\na new West Hollywood Municipal Code Chapter 5.129.
