8G. Approve a Memorandum of Understanding (MOU) with North\nCounty Transit District (NCTD) for Design of Quiet Zone\nImprovements. Environmental Considerations: The action\nbeing considered by the City Council is not subject to the\nCalifornia Environmental Quality Act (CEQA) because it is not\na "project" per Section 15378(b)(5) of the CEQA Guidelines.\nThe action authorizes staff to implement an organizational or\nadministrative activity of government that by itself will not\nresult in a direct or indirect physical change in the\nenvironment. Contact Person: Principal Engineer Widelski\nRecommended Action: 1) Authorize the City Manager, in\nconsultation with the City Attorney, to finalize and execute an\nMOU with NCTD, in substantial form, and any necessary\namendments and time extension for the design of the Quiet\nZone Improvements; 2) Direct staff to pay $600,000 to NCTD\nto fund the Design of Quiet Zone Improvements within 30 days\nof execution of the MOU; and 3) As design circumstances\nnecessitate, direct staff to pay NCTD additional required Quiet\nZone design or design support costs, up to the current\nbalance in Project No. CS23B of approximately $750,000.\n2023-03-22 Item 08G MOU for Quiet Zone NCTD Encinitas
