DEVELOPMENT APPLICATION NO. 2021-00137\nFINAL ENVIRONMENTAL IMPACT REPORT (FEIR) NO. 355 AND\nMITIGATION MONITORING PROGRAM NO. 390\nGENERAL PLAN AMENDMENT\nHILLS PRESERVE SPECIFIC PLAN\nZONING RECLASSIFICATION\nZONING CODE AMENDMENT (CHAPTER 18.124) - HILLS PRESERVE SPECIFIC PLAN\nTENTATIVE TRACT MAP NO. 19228\nFINAL PLAN\nDISCRETIONARY TREE REMOVAL PERMIT\nDEVELOPMENT AGREEMENT\nAPPLICANT/OWNER: SALT Development, LLC, 205 North 400 West, Suite 300, Salt Lake\nCity, UT 84103\nPROJECT LOCATION: The approximately 76-acre property is along the south side of Santa\nAna Canyon Road, generally between Eucalyptus Drive to the west and Festival Drive to the\nhttps://local.anaheim.net/docs_agend/questys_pub/43918/Agenda.html 9/12\n10/25/24, 1:40 PM local.anaheim.net/docs_agend/questys_pub/43918/Agenda.html\neast. REQUEST: The applicant requests approval of a General Plan Amendment, Specific\nPlan, Zoning Reclassification, Zoning Code Amendment, Tentative Tract Map, Final Plan,\nDiscretionary Tree Removal Permit, and Development Agreement to permit and construct a\n498-unit multiple-family residential building and 40,000 square feet of commercial uses, with\napproximately 50 acres designated as Open Space (Environmental Impact Report Alternative\n#2). The following are the proposed applications associated with the request:\nGENERAL PLAN AMENDMENT: The applicant requests an amendment to Figure LU-4 (Land\nUse Plan) of the General Plan Land Use Element to re-designate portions of the Project Site\nfrom “Estate Density Residential”, “Low Density Residential”, and “Open Space” to “Medium\nDensity Residential”, “Open Space”, and “General Commercial”, and to amend Figure C-2 of\nthe Circulation Element.\nHILLS PRESERVE SPECIFIC PLAN: The applicant has proposed the “Hills Preserve Specific\nPlan” to establish a land use vision and implement land use designations for commercial,\nresidential, and open space development areas.\nZONING RECLASSIFICATION: The applicant requests to reclassify the property as the “Hills\nPreserve Specific Plan” zoning designation.\nZONING CODE AMENDMENT: The applicant requests to amend the Anaheim Municipal Code\n(Code) to establish standards and procedures to implement the Hills Preserve Specific Plan\nwhich would be added as Chapter 18.124 of the Code.\nTENTATIVE TRACT MAP NO. 19228: The applicant requests to subdivide the property\ngenerally into three development areas in accordance with the Hills Preserve Specific Plan and\nto provide for internal circulation with private streets for public use including Deer Canyon\nRoad.\nFINAL PLAN: The applicant requests approval of a Final Plan for the Multiple-Family\nDevelopment Area to permit the construction of apartments and associated improvements. The\nFinal Plan includes items such as the site plan, floor plans, elevations, and landscape plan to\ndemonstrate compliance with the guiding principles and standards as proposed in the Hills\nPreserve Specific Plan.\nDISCRETIONARY TREE REMOVAL PERMIT: The applicant requests to remove trees on the\nproject site within the Scenic Corridor Overlay Zone that the Code defines as “specimen trees”\nwhich are not dead, diseased, weakened, or otherwise posing a threat to persons or property.\nDEVELOPMENT AGREEMENT: The applicant requests approval of a Development\nAgreement between the City of Anaheim and SALT Development, LLC to provide certainty to\nthe developer to facilitate development of the Specific Plan, and to provide specified benefits to\nthe City including a contribution to the City’s Affordable Housing Trust Fund; improvement of\nDeer Canyon Road and trail, Santa Ana Canyon Road and trail; designation of approximately\n50 acres of Open Space; Operations and Maintenance agreement for the Deer Canyon Road\nand Santa Ana Canyon Road signalized intersection; and a one-time Fire Protection\nEnhancement Payment.\nENVIRONMENTAL DETERMINATION: The City Council will consider whether to certify Final\nEnvironmental Impact Report (FEIR) No. 355 and adopt Findings of Fact, Statement of\nOverriding Considerations, and Mitigation Monitoring Program (MMP) No. 390 and determine\nthat FEIR No. 355 and MMP No. 390 is the appropriate environmental documentation for the\nproject.\nACTION TAKEN BY THE PLANNING COMMISSION:\nRecommended City Council approval of the project consistent with Alternative #2 from EIR No.\n355 - which includes the reduction of commercial uses from 80,000 square feet to 40,000\nsquare feet and the elimination of the six single-family detached residential lots – with the\ncondition that the applicant provide a covenant requiring the preservation and maintenance of\nall Open Space (increased from 43.2 to 50 acres with Alternative #2) so that it could not be\ndeveloped in the future: approved Resolution Nos. PC2024-031 (Recommended the City\nCouncil approve and adopt proposed General Plan Land Use and Circulation Element\nAmendment); PC2024-032 (Recommended the City Council approve and adopt a proposed\nDevelopment Agreement by and between the City of Anaheim and SALT Development, LLC);\nPC2024-033 (Approved Tentative Tract Map No. 19228 and making certain findings in\nconnection therewith); and adopted motions recommending City Council approval of the\nSpecific Plan, Zoning Reclassification, Zoning Code Amendment, and Final Plan (Multiple-\nFamily Development). VOTE: 4-2 (Chairperson Walker and Commissioners Perez, Tran-Martin,\nand Kring voted yes; Commissioners Lieberman and Castro voted no; Commissioner Kelly was\nabsent) (Resolution Nos. PC2024-031 through PC2024-033 and approvals of a Specific Plan,\nhttps://local.anaheim.net/docs_agend/questys_pub/43918/Agenda.html 10/12\n10/25/24, 1:40 PM local.anaheim.net/docs_agend/questys_pub/43918/Agenda.html\n)( g\nZoning Reclassification, Zoning Code Amendment, and Final Plan (Multiple-Family\nDevelopment)); and approved Resolution No. PC2024-034 (Recommended City Council certify\na Final Environmental Impact Report and adopt Findings of Fact, a Statement of Overriding\nConsiderations, and Mitigation Monitoring Program No. 390 for the project and related actions);\nand adopted a motion recommending City Council approval of a Discretionary Tree Removal\nPermit including a condition requiring the applicant to evaluate the tree removal plan to\ndetermine if any additional trees could be preserved and/or replanted.
