A. Introduction and Adoption by First Reading of Ordinance No. 750 repealing Ordinance No. 689,\nterminating Development Agreement No. 18-017C between the City of Cudahy and Nyce Guys,\nLLC (page 41)\nPresented by the Senior Planner\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that Nyce Guys, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-017C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 750 repealing\nOrdinance No. 689 terminating DA No. 18-017C, between the City of\nCudahy and Nyce Guys, LLC; and\n4. Schedule the second reading of Ordinance No. 750 at the next\nregularly scheduled meeting on August 20, 2024; and\n5. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
