C. Introduction and Adoption by First Reading of Ordinance No. 752 repealing Ordinance No. 676,\nterminating Development Agreement No. 18-019C between the City of Cudahy and Cuper\nDevelopment, LLC (page 1795)\nPresented by the Senior Planner\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open the public hearing and receive public comments and testimony;\nand\n2. Make a determination that Cuper Development, LLC (“Operator”) is\nnot in compliance with the terms and conditions of Development\nAgreement (“DA”) No. 18- 019C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 752 repealing\nOrdinance No. 676 terminating DA No. 18-019C, between the City of\nCudahy and Cuper Development, LLC; and Schedule the second\nreading of Ordinance No. 752 at the next regularly scheduled meeting\non August 20, 2024; and\n4. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
