B. Introduction and Adoption by First Reading of Ordinance No. 751 Repealing Ordinance No. 698,\nTerminating Development Agreement No. 18-001C between the City of Cudahy and VM\nEvergreen, LLC (page 603)\nPresented by the Senior Planner\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that VM Evergreen, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-001C with the City and find that the\nOperator is in default of contractual obligations set forth in the DA;\nand\n3. Introduce and adopt by first reading Ordinance No. 751 repealing\nOrdinance No. 698 terminating DA No. 18-001C, between the City of\nCudahy and VM Evergreen, LLC; and Schedule the second reading of\nOrdinance No. 751 at the next regularly scheduled meeting on August\n20, 2024; and\n4. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
