38. Belvedere Garbage Disposal District Services Contract\nRecommendation: Acting as the Governing Body of the County Garbage\nDisposal District, for the Belvedere Garbage Disposal District (1), determine\nthat the recommended actions are within the scope of the Belvedere\nGarbage Disposal District Project impacts analyzed in the Negative\nDeclaration and Addendum previously adopted by the Board; award a\ncontract for Belvedere Garbage Disposal District to Valley Vista Services,\nInc., consisting of two separate tasks: Customer Service (Task 1), for\ncollection of refuse, recyclables, and organic waste, with an initial annual\ncontract amount of $16,242,089, and County Services (Task 2), for daily\nmonitoring for illegal dumping and collection of solid waste discarded in\npublic rights-of-way and alleys, for an initial annual contract amount not to\nexceed $2,924,383, effective upon Board approval and final execution by\nboth parties, whichever occurs last, with services to start as early as July 1,\n2024 and expire on June 30, 2031, for a seven-year term, with two,\ntwo-year extension options, for a potential maximum contract term of 12\nyears, and a maximum potential contract amount of $229,997,664, which\ndoes not include rate adjustments for changes affecting the solid waste\nindustry, including prices for labor, fuel, and the processing of various types\nof commodities, unforeseen additional work and changes in law as\nauthorized by the contract; and authorize the Director of Public Works to\ntake the following actions: (Department of Public Works) APPROVE\nAdjust the monthly rate per customer as billed by the contractor for\nadditional Customer Services, such as more containers or collection\nas a higher frequency, billed directly to the customers, the monthly\nrate billed to the County by the contractor for County Services and\nthe contract amount, if applicable, by up to 10% of the annual\ncontract amount for unforeseen, additional work with the scope of the\ncontract, and for changes in the law, adjust the annual contract\namount for any change in unit counts based on the Office of the\nAssessor's tax roll, which determines he contractor's annual\ncompensation, and adjust the unit rates annually up to 5% each year\nover the initial seven-year period and up to 5% annually for each\noptional renewal year, if applicable, to allow for changes affecting the\nsolid waste industry, including prices for labor, fuel and the\nprocessing of various types of commodities; and\nExecute and take all necessary and appropriate steps to carry out this\ncontract, renew the contract for each additional renewal option and\nextension period if, in the opinion of the Director of Public Works, the\ncontractor has successfully performed during the previous contract period\nand the services are still required, approve and execute amendments to\nincorporate necessary changes within Task 1 and Task 2 and\nspecifications, and to suspend work if, the opinion of the Director, it is in the\nbest interest of the County to do so.
