56. Del Valle Grading Project Construction Contract\nRecommendation: Find that the Del Valle Grading Project, Capital Project (CP)\nNo. 89159 (Project), located at 28101 Chiquito Canyon Road in Castaic (5), is\nwithin the scope of the previously adopted Negative Declaration for the Project\nunder the California Environmental Quality Act; approve the Project (Project),\nwith a Project budget of $1,326,000; approve an appropriation adjustment to\ntransfer $826,000 from Del Valle New Infrastructure, CP No. 89034, and\n$500,000 from Del Valle Various Mitigation/Remediation Projects, CP No.\n89040, to the Project, to fully fund the Project; adopt the plans and\nspecifications, and advertise for bids to be received by 10:00 a.m. on\nSeptember 11, 2023; and authorize the Director of Public Works to take the\nfollowing actions: (Department of Public Works) ADOPT\nExecute a consultant services agreement with the apparent lowest\nresponsive and responsible bidder to prepare a baseline schedule for an\namount not to exceed $5,000, funded by the Project funds;\nDetermine that a bid is nonresponsive and reject a bid on that basis,\naward the next lowest responsive and responsible bidder, waive\ninconsequential and nonmaterial deficiencies in bids submitted, and\ndetermine, in accordance with the applicable contract and bid\ndocuments, whether the apparent lowest responsive and responsible\nbidder has timely prepared a satisfactory baseline construction schedule\nand satisfied all conditions for contract award, and upon that\ndetermination, award and execute a construction contract to the apparent\nlowest responsive and responsible bidder, if the low bid can be awarded\nwithin the approved total budget, establish the effective date of the\ncontract upon receipt of acceptable performance and payment bonds\nand evidence of required contractor insurance, and take all other actions\nnecessary and appropriate to deliver the Project;\nExecute any easements, permits, and utility connection agreements\nnecessary for the completion of the Project, provided that the costs\nrelated to these easements, permits, and agreements do not cause the\nProject to exceed the approved Project budget; and\nCarry out, manage, and deliver the Project on behalf of the Consolidated\nFire Protection District, award and execute consultant agreements,\namendments, and supplements within the same authority and limits\ndelegated to the Director of Public Works by the Board for County\nCapital Improvement Projects, accept the Project, and release retention\nupon acceptance.
