17. Award a Design-Build Contract for the North Hollywood Health Center\nRecommendation as submitted by Supervisor Barger: Approve the North\nHollywood Health Center Project (NHHC), Capital Project (CP) No. 69989\n(Project), with a revised Project budget of $92,975,000; approve an\nappropriation adjustment to reflect an increase of $92,975,000 in appropriation\nto the NHHC Project to fully fund the Project, which will be fully offset by the\nrecognition of $89,300,000 of the American Rescue Plan Act (ARPA)\nCoronavirus Local Fiscal Recovery Funds for the Project via ARPA’s revenue\nloss provisions, and the transfer of $3,675,000 from CP No. 87426, Various\nPublic Health Center Project; find that Swinerton Builders is the responsive and\nresponsible proposer that submitted the best value and most advantageous\nproposal to the County for design and construction of the Project using the\nDesign-Build (D-B) delivery method, based on best value criteria stated in the\nRequest for Proposals, including qualifications, technical design, construction\nexpertise, proposed delivery plan, price, workforce commitment, design\nexcellence, acceptable safety record, and lifecycle cost; find that the NHHC\nProject is within the scope of the Board’s previous finding of exemption for the\nProject under the California Environmental Quality Act, and upon Board\napproval, instruct the Director of Public Works to file a Notice of Exemption with\nthe Registrar-Recorder/County Clerk; and authorize the Director of Public\nWorks to take the following actions: 4-VOTES\nAward and execute a D-B contract for the design and construction of the\nNHHC Project for a contract amount not to exceed $73,000,214 and a\ndesign completion allowance not to exceed $1,900,000, for a maximum\ncontract amount not to exceed $74,900,214; and establish the effective\ndate of the contract upon receipt by Public Works of acceptable\nperformance and payment bonds and evidence of required contractor\ninsurance, and to take all other actions necessary and appropriate to\ndeliver the Project;\nAward and execute consultant services agreements with Abbot\nConstruction, LLC, and Charles Pankow Builders, LTD., to pay stipends\nin the amount of $80,000 each to the second and third ranked qualifying\nproposers that were not selected as the best value D-B;\nWith concurrence of the Chief Executive Officer, exercise control over\nthe design completion allowance, including the authority to reallocate the\nallowance into the contract amount, as appropriate, in accordance with\nthe Project specifications;\nApprove extra costs for any change or addition to the work on this\nProject, provided that the extra cost of any such individual change or\naddition to the work does not exceed $750,000, and further provided that\nthere is sufficient remaining budget for the Project to cover such costs or\nchanges, and further subject to the limit that the aggregate amount of all\nsuch delegated authority change orders do not to exceed 25% of the\noriginal contract amount as set forth in the Public Contract Code Section;\nReport back to the Board monthly on the change orders granted under\nthe above delegated authority for the NHHC Project and find that this\nmonthly reporting constitutes a sufficient and appropriate measure to\nprevent fraud and ensure accountability for the delegated authority to the\nDirector to approve extra costs for any change or addition to the work;\nand\nDeliver the make-ready work for the NHHC Project using Board-approved\nJob Order Contracts.
