I.16\nTELECOMMUNICATIONS LICENSE AGREEMENT WITH NEW CINGULAR\nWIRELESS PCS, LLC FOR A CELL TOWER AT EL POTRERO PARK (REPORT\nOF: PARKS AND COMMUNITY SERVICES) (DISTRICT 4)\nTelecommunications License Agreement – El Potrero Park (Site ID# CSL04656/FA#\n15547709) With New Cingular Wireless PCS, LLC for Rental/Lease of Ground Area\nand Maintenance Fees Associated with the Installation and Operation of a Cell Tower\n(Mono-Pine)\nRecommendation(s)\nThat the City Council and CSD:\n1. Authorize the City Manager/Executive Director of the Moreno Valley CSD to\nexecute the Telecommunications License Agreement, as approved by the City\nAttorney with Licensee, New Cingular Wireless PCS, LLC, a Delaware limited liability\ncompany, for a License/Lease Agreement of 713 square feet of ground area located\nin El Potrero Park, as described in the Telecommunications License Agreement for\nthe installation and use of telecommunications and related equipment for cellular\ntelecommunications operations. Licensee agrees, per the terms of the Agreement to\npay to Licensor (City/CSD) License Rental Fees that include a one-time payment of\n$25,000.00 and thereafter on the anniversary of the Commencement Date an annual\nLicense Rental Fee of $39,000.00, which shall increase annually at a rate of either\nCPI or 3%, whichever is greater, per the terms of the Agreement. Licensee further\nAgrees that upon acceptance of the site improvements, Licensee will pay a graffiti\nremoval and landscape maintenance fee in the amount of $100.00 per month, which\nshall increase annually at a rate of CPI of 3%, whichever is greater, per the terms of\nthe Agreement. The term of this Agreement shall be for five (5) years commencing on\nthe Commencement Date and Licensee shall have the right to extend the Term of\nthis License for five (5) additional terms ("Renewal Terms") of five (5) years each, per\nthe Agreement.\n2. Authorize the City Manager/Executive Director of the Moreno Valley CSD and/or\ntheir designee to submit necessary budget adjustments as applicable.
