I.\nConsideration of Award of Public Works Agreement to Covenant\nTechnical Solutions, Inc., and Approval of Amendment 3 to Professional\nServices Agreement with Pacific Advanced Civil Engineering, Inc. for\nEngineering Services, Professional Services Agreement with Butier\nEngineering, Inc. for Construction Management and Inspection Services,\nand Authorization to Enter Into a New Orange County Water District\nProducer Well Construction Loan Agreement, and Approval for Budget\nAmendment BA #26-03-03, for the Lampson Well Treatment System\nProject, CIP WT1902 - That the City Council adopt Resolution 7689: 1.\nApproving the plans, specifications, and contract documents for the Lampson\nWell Treatment System Project, CIP WT1902 (Project); and, 2. Sustaining the\nbid protest of Metro Builders & Engineers Group, Ltd. (Metro Builders), and\nrejecting the bid of apparent low bidder, RE Chaffee Construction, Inc.\n(Chaffee), as non-responsive; and, 3. Awarding a Public Works Agreement\nwith Covenant Technical Solutions, Inc. (CTS) for the Project in the not-toexceed amount of $5,649,257, overruling the bid protest filed by Metro\nBuilders contending that the bid was non-responsive, finding that CTS is the\nlowest responsible bidder, waiving minor bid irregularities in the bid, and\nrejecting all other bids; and, 4. Authorizing the City Manager to execute the\nPublic Works Agreement with Covenant Technical Solutions, Inc. for the\nProject; and authorizing the City Manager to approve additional work requests\nand construction support/testing/inspection services up to $565,000\n(approximately 10%), in connection with the Project; and, 5. Approving\nAmendment 3 to the Professional Services Agreement with Pacific Advanced\nCivil Engineer, Inc. for Engineering Services extending the term through and\nincluding June 30, 2028, and increasing the compensation by $144,870 for a\nrevised total not-to-exceed amount of $586,475 for the Project; and, 6.\nApproving a Professional Services Agreement with Butier Engineering, Inc. for\nConstruction Management and Inspection Services for the Project in the notto-exceed amount of $494,722, and rejecting all other proposals; and, 7.\nAuthorizing the City Manager to execute a Professional Services Agreement\nfor Construction Management and Inspection Services with Butier\nEngineering, Inc. for the Project; and authorizing the City Manager to approve\nadditional construction management and inspection services up to $50,000\n(approximately 10%), in connection with the Project; and, 8. Approving and\nAuthorizing the City Manager to execute a new Orange County Water District\nProducer Well Construction Loan Agreement reflecting an updated loan\namount of $7,000,000; and, 9. Directing the City Manager to accept and\nexpend the revised Orange County Water District Producer Well Construction\nLoan Agreement amount; and, 10. Approving Budget Amendment BA #26-0303 in the amount $2,550,000 for CIP WT1902.
