3.\nADOPTION OF ORDINANCE NO. O-25-1418 AMENDING THE\nFOLLOWING MUNICIPAL CODE SECTIONS: (1) 23.13.04 (B)(2)(D) TO\nSTATE THAT NO HEDGE SHALL EXCEED THE GREATER OF FIVE (5’)\nFEET OR THE HEIGHT OF A LEGALLY EXISTING OR PERMITTED WALL\nOR FENCE WITHIN THE R-1 ZONE, AREA DISTRICT II; (2) 25.01.02 (D)\nTO PROHIBIT CONSTRUCTION ON MARTIN LUTHER KING JR. DAY;\nAND (3) 23.06.11 TO INCLUDE CALAMITIES AS DETERMINED BY THE\nCOMMUNITY DEVELOPMENT DIRECTOR OR CITY MANAGER\nRecommendation: Staff recommends the City Council adopt Ordinance No. O-251418. If the City Council concurs with staff’s recommendation, an appropriate motion\nwould be:\n“I move to adopt Ordinance No. O-25-1418, an Ordinance of the San Marino City\nCouncil amending Municipal Code Sections (1) 23.13.04 (B)(2)(D) to state that no\nhedge shall exceed the greater of five feet (5’) or the height of a legally existing or\npermitted wall or fence within the R-1 Zone, Area District II; (2) 25.01.02 (D) to\nprohibit construction on Martin Luther King Jr. Day; and (3) 23.06.11 to include\ncalamities as determined by the Community Development Director or City Manager."
