11.11 Consideration of a Resolution Approving a Permanent Street\nEasement and Temporary Construction Easement Agreement\nwith Levine, Zittrer and Schumer LLC\nRECOMMENDATION: It is staff’s recommendation that the City\nCouncil adopt the attached Resolution authorizing the City Manager\nto execute the Purchase Agreement, Grant Deed and Temporary\nConstruction Easement documents with Levine, Zittrer and Schumer,\nLLC, for the acquisition of a portion of private property at 8438\nEastern Avenue for right-of-way for the Garfield Avenue and Eastern\nAvenue Intersection Improvements Project.\nCONCLUSION: Adopting the attached Resolution will allow the City to\nacquire the necessary property to proceed with construction of the\nProject\nFISCAL IMPACT: Existing I-710 Early Action Project Grant funds of\n$34,341 are available for right-of-way acquisition and administrations\ncost.\nATTACHMENTS:\nExhibit 1 – Resolution 2025-93\nExhibit 2 – Agreement\nExhibit 3 – Project Site Plan
