46.\nCommunity Facilities District No. 2022-3 Joint Community Facilities\nAgreement\nRecommendation: Acting as the Governing Body of the County Waterworks\nDistrict No. 40, Antelope Valley (District); find that the proposed actions are not\na project under the California Environmental Quality Act (CEQA), alternatively,\nto the extent they are a project, acting as a responsible agency for the Ritter\nRanch Specific Plan for which an Environmental Impact Report (EIR) has been\ncertified and an addendum has been adopted by the lead agency, the City of\nPalmdale (5). Certify that the Board has independently reviewed, considered,\nand reached its own conclusions regarding the environmental effects of the\nDistrict. Adopt the Mitigation Monitoring Program as applicable to the project,\nfinding that the Mitigation Monitoring and Reporting Program is adequately\ndesigned to ensure compliance with the mitigation measures during project\nimplementation and determine that there are no significant and adverse effects\nfrom the proposed activities by the District for the project. Adopt the Findings of\nFact that are incorporated herein by reference, as applicable and find that the\nactions recommended by the District are within the scope of the EIR. Approve\nthe Joint Community Facilities Agreement (Agreement) between the City of\nPalmdale, RdR Development Holdings, LLC and the District, for Community\nFacilities District (CFD) No. 2022-3. Authorize the Director of Public Works to\nexecute the Agreement on behalf of the District, and any necessary additional\ntransactional documents. Approve the Funding and Acquisition agreement\nbetween the City of Palmdale, RdR Development Holdings, LLC and the District,\nfor CFD No. 2022-3 infrastructure reimbursement. Authorize the Director to\nexecute the Funding and Acquisition Agreement on behalf of the District, and\nany necessary additional transactional documents.
