Los Angeles City Council Agenda Wednesday, June 5, 2024 JOHN FERRARO COUNCIL CHAMBER ROOM 340, CITY HALL 200 NORTH SPRING STREET, LOS ANGELES, CA 90012 ­ 10:00 AM Roll Call Approval of the Minutes Commendatory Resolutions, Introductions and Presentations Multiple Agenda Item Comment Public Testimony of Non­agenda Items Within Jurisdiction of Council Items for which Public Hearings Have Been Held (1) 24­0555 CD 15 CATEGORICAL EXEMPTION AND RELATED CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS and PLANNING AND LAND USE MANAGEMENT (PLUM) COMMITTEE REPORT relative to preparing an ordinance with an Urgency Clause to amend the Los Angeles Municipal Code (LAMC) to add Subdivision 36 to Subsection A of Section 12.22 of Article 2 of Chapter 1 to regulate new or expanded trucking­related uses in the Wilmington­Harbor City Community Plan Area. Recommendations for Council action: 1. DETERMINE, based on the whole of the administrative record, that the proposed Ordinance is exempt from the CEQA pursuant to CEQA Guidelines Sections 15061(b)(3), 15308 (Class 8), and no exception to a categorical exemption pursuant to CEQA Guidelines Section 15300.2 applies. 2. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of Council. 3. REQUEST the City Attorney to prepare and present an ordinance with an Urgency Clause to add Subdivision 36 to Subsection A of Section 12.22 of Article 2 of Chapter 1 of the LAMC to regulate new or expanded trucking­related uses in the Wilmington­Harbor City Community Plan Area, with the amendments approved by the PLUM Wednesday - June 5, 2024 - PAGE 5 Committee on May 21, 2024, to Section 12.22.A.36(c)(7) of the 2. ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) as the Findings of Council. 3. REQUEST the City Attorney to prepare and present an ordinance with an Urgency Clause to add Subdivision 36 to Subsection A of Section 12.22 of Article 2 of Chapter 1 of the LAMC to regulate new or expanded trucking­related uses in the Wilmington­Harbor City Community Plan Area, with the amendments approved by the PLUM Committee on May 21, 2024, to Section 12.22.A.36(c)(7) of the LAMC, to include language clarifying that commercial uses of land are excluded from the Trucking Terminal definition: 7. Trucking Terminal. A building, structure, or principal use of land where freight trucks dock to unload/ load and transport goods, and which may include the storage of freight trucks or truck trailers or associated equipment/accessories, including, but not limited to, chassis, container stackers, cranes, and forklift trucks. Trucking Terminal does not include commercial uses of land such as grocery or retail stores with loading docks.
