(26) 23­0187­S1 PUBLIC SAFETY COMMITTEE REPORT relative to recommendations and implementation plans to modify Charter Section 1070 in connection with the Los Angeles Police Department Board of Rights. Recommendations for Council action: 1. REQUEST the City Attorney, with the assistance of the Chief Legislative Analyst (CLA) and the City Administrative Officer (CAO), to prepare and present the required Resolution(s) to place on the November 5, 2024 General Election Ballot, a stand­alone measure to amend the Charter Section 1070 in the following ways: a. Require the Board of Rights composition be made up of one sworn officer with the rank of Captain or above, and two Civilian Hearing Officers, as well as delete the second paragraph of Charter Section 1070 (h) that allows for an all civilian composition option of the Board of Rights through Ordinance. Tuesday - June 4, 2024 - PAGE 23 to prepare and present the required Resolution(s) to place on the November 5, 2024 General Election Ballot, a stand­alone measure to amend the Charter Section 1070 in the following ways: a. Require the Board of Rights composition be made up of one sworn officer with the rank of Captain or above, and two Civilian Hearing Officers, as well as delete the second paragraph of Charter Section 1070 (h) that allows for an all civilian composition option of the Board of Rights through Ordinance. b. Approval by the Voters would result in the repealing of Ordinance No. 186100. c. Grant the Chief of Police the power to terminate a peace officer for cause, including types of misconduct described in California Senate Bill 2, prior to an appeal process outside of the Board of Rights model. d. Establish binding arbitration as the appeal process. e. All terminated officers must still be afforded an appeal process after termination. 2. INSTRUCT the CAO to initiate discussions with the City’s Labor partners upon action by the Council. Fiscal Impact Statement: None submitted by the CLA. The CAO has not completed a financial analysis of this report.
