(23) 23­1403 CD 4 CATEGORICAL EXEMPTION and PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to a California Environmental Quality Act (CEQA) appeal filed for the properties located at 7315 – 7321 West Pyramid Place. Recommendations for Council action: 1. DETERMINE, that based on the whole of the administrative record, that substantial evidence supports that the project is exempt from Friday the CEQA- June 21, 2024 pursuant - to CEQA 15303,23 Guidelines, SectionPAGE Class 3(a) and none of the exceptions to a categorical exemption pursuant to CD 4 CATEGORICAL EXEMPTION and PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to a California Environmental Quality Act (CEQA) appeal filed for the properties located at 7315 – 7321 West Pyramid Place. Recommendations for Council action: 1. DETERMINE, that based on the whole of the administrative record, that substantial evidence supports that the project is exempt from the CEQA pursuant to CEQA Guidelines, Section 15303, Class 3(a) and none of the exceptions to a categorical exemption pursuant to CEQA Guidelines Section 15300.2 applies. 2. ADOPT the amended FINDINGS of the South Valley Area Planning Commission (SVAPC) as the Findings of Council. 3. RESOLVE TO DENY THE APPEAL filed by Angelenos for Trees (Representative: Jamie T. Hall), and THEREBY SUSTAIN the determination of the Department of City Planning’s (DCP) Supplemental report dated May 30, 2024, in approving a Categorical Exemption as the environmental clearance for the construction, use, and maintenance of a new 3,765 square­foot, three­story single family residence with an attached 380 square­foot street level, two­car garage on a lot fronting on a Substandard Hillside Limited Street; receive and file the DCP report dated April 10, 2024; accept the Revised CEQA justification, which includes the following information: 0 cubic yards of import and 560 cubic yards of export and has no substantive effect on the conditions, findings or environmental analysis, attached to the Council file; approve the modifications to Conditions of Approval Nos. 17 (d), 18, and 20 of Case No. ZA­2021­10466­ZAD­DRB­SPP­MSP­1A; require the applicant to submit updated plans as part of Exhibit A of the Zoning Administrator case; and, authorize the DCP to make any correction, clarifications, or revisions to the above recommendations in order to effectuate the intent of the May 30, 2024 DCP report; for the properties located at 7315­7321 West Pyramid Place.
