(33) 24­0611 ADMINISTRATIVE EXEMPTION and TRADE, TRAVEL AND TOURISM COMMITTEE REPORT relative to the Second Amendment to Contract No. DA­5503 with Nossaman LLP for legal advice in connection with insurance coverage issues. Recommendations for Council action: 1. ADOPT the determination by the Board of Airport Commissioners (BOAC) that this action is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2(f) of the City of Los Angeles CEQA Guidelines. 2. APPROVE the Second Amendment to Contract No. DA­5503 with Nossaman LLP to increase the contract authority by $150,000, for new total not to exceed $500,000, and extend the term through March 31, 2025, covering legal advice in connection with insurance coverage issues, including Los Angeles World Airports’ (LAWA) claim for business income loss under its Commercial Property Policy as a result of the COVID­19 pandemic and pursuit of any related civil litigation. 3. CONCUR with the BOAC action on March 7, 2024, by BOAC Resolution No. 27910, Authorizing the Chief Executive Officer, LAWA, or designee, to execute said Second Amendment to Contract No. DA­5503 with Nossaman LLP. Fiscal Impact Statement: The BOAC reports that there is no impact to the General Fund. The City Administrative Officer reports that approval of the proposed Second Amendment to Contract No. DA­5503 with Nossaman LLP to increase the contract authority by $150,000, from $350,000 to $500,000, for assisting the LAWA and the City Attorney with legal advice in connection with insurance coverage issues and litigation will have no Friday impact on the- City’s June 21, 2024 - Fund. Costs for related General PAGE 41 expenses are available in the Fiscal Year 2023­24 LAWA Operating Budget in Cost LAWA, or designee, to execute said Second Amendment to Contract No. DA­5503 with Nossaman LLP. Fiscal Impact Statement: The BOAC reports that there is no impact to the General Fund. Costs for related expenses are available in the Fiscal Year 2023­24 LAWA Operating Budget in Cost Center 1110004 – Legal Services Division, Commitment Item 520 – Contractual Services. Funding for subsequent years will be requested as part of LAWA’s annual budget process. The recommendations in this report comply with the LAWA’s adopted Financial Policies.
