(5)\n20-1616\nENERGY AND ENVIRONMENT COMMITTEE REPORT relative to the\nFifth Amendment to an Agreement for Customer Information System\n(CIS) Support and Upgrade Services with Oracle America, Inc.\nRecommendations for Council action:\n1. APPROVE the Department of Water and Power (DWP) Board\nResolution authorizing the DWP to execute a Fifth Amendment\nto Agreement No. 47372B with Oracle America, Inc., extending\nthe term of January 20, 2016 through January 19, 2026, by 18\nmonths through July 19, 2027, for a total term of 11 years and\nsix months, and increasing the funding by $15,000,000 for a\nnew total not-to-exceed amount of $131,500,000, allowing\nOracle America, Inc. to continue delivering CIS Support and\nUpgrade Services.\n2. AUTHORIZE and DIRECT, upon proper certification, the Chief\nAccounting Employee to draw demands on the Water and\nPower Revenue Funds over the term of the Agreement, in\naccordance with the terms of the Fifth Amendment and\naccompanying Board Resolution.\nFiscal Impact Statement: The City Administrative Officer reports that\nthere is no General Fund impact. Approval of the proposed Board\nResolution authorizes additional expenditures of $15,000,000,\nincreasing to total not-to-exceed amount from $116,500,000 to\n$131,500,000, as appropriate for CIS ongoing support services and\ncourt-mandated settlement activities. The not-to-exceed amount is\nfunded by the DWP Water and Power Revenue Fund. The above\nrecommendations comply with the DWP adopted Financial Policies.
