(4)\n25-1011\nENERGY AND ENVIRONMENT COMMITTEE REPORT relative to the\nSecond Amendment to the Master Memorandum of Understanding\n(MOU) for Project Delivery and Service Needs with the City.\nRecommendations for Council action:\n1. APPROVE the Department of Water and Power (DWP) Board\nResolution authorizing the DWP to execute a Second\nAmendment to the Master MOU with the City to effectuate the\nfollowing:\na. Extend the term by an additional five years for a total of\nten years, from September 26, 2025 to September 25,\n2030.\nb. Increase the total cost for services by $20 million for a\ntotal not-to-exceed cost of $60 million.\nc. Add the Bureau of Street Lighting to the list of City\ndepartments and bureaus agreeing to provide services to\nDWP.\n2. AUTHORIZE, upon proper certification, the Chief Accounting\nEmployee to draw demands on the Water and Power Revenue\nFunds, in accordance with the terms of this Amendment to the\nMOU and Board Resolution.\nFiscal Impact Statement: The City Administrative Officer reports that\napproval of the Second Amendment to the Memorandum of\nAgreement with the City for project delivery and service needs may\nhave a potential revenue impact to the General Fund. Revenue is\ndependent on acceptance of DWP work. Approval of the proposed\nBoard Resolution and contract amendment will increase the not-toexceed cost for services by $20 million, from $40 million to $60\nmillion. Funding will available and budgeted as part of individual\nproject budgets in the Water and Power Revenue Funds. The\nrecommendations above comply with the DWP adopted Financial\nPolicies.

(5)\n20-1616\nENERGY AND ENVIRONMENT COMMITTEE REPORT relative to the\nFifth Amendment to an Agreement for Customer Information System\n(CIS) Support and Upgrade Services with Oracle America, Inc.\nRecommendations for Council action:\n1. APPROVE the Department of Water and Power (DWP) Board\nResolution authorizing the DWP to execute a Fifth Amendment\nto Agreement No. 47372B with Oracle America, Inc., extending\nthe term of January 20, 2016 through January 19, 2026, by 18\nmonths through July 19, 2027, for a total term of 11 years and\nsix months, and increasing the funding by $15,000,000 for a\nnew total not-to-exceed amount of $131,500,000, allowing\nOracle America, Inc. to continue delivering CIS Support and\nUpgrade Services.\n2. AUTHORIZE and DIRECT, upon proper certification, the Chief\nAccounting Employee to draw demands on the Water and\nPower Revenue Funds over the term of the Agreement, in\naccordance with the terms of the Fifth Amendment and\naccompanying Board Resolution.\nFiscal Impact Statement: The City Administrative Officer reports that\nthere is no General Fund impact. Approval of the proposed Board\nResolution authorizes additional expenditures of $15,000,000,\nincreasing to total not-to-exceed amount from $116,500,000 to\n$131,500,000, as appropriate for CIS ongoing support services and\ncourt-mandated settlement activities. The not-to-exceed amount is\nfunded by the DWP Water and Power Revenue Fund. The above\nrecommendations comply with the DWP adopted Financial Policies.

(6)\n25-1003\nENERGY AND ENVIRONMENT COMMITTEE REPORT relative to a\ncontract with McCrometer Inc. for the installation, calibration, and\nmaintenance of flow monitors in the City wastewater collection system\nand providing flow gauging data.\nRecommendation for Council action:\nAUTHORIZE the Board of Public Works (BPW), or two members, on\nbehalf of the Bureau of Sanitation, to execute the proposed Contract\nwith McCrometer Inc. for the installation, calibration, and\nmaintenance of flow monitors in the City wastewater collection\nsystem and providing flow gauging data for a term of five years with\none five-year renewal option and six month-to-month renewal options\nat the discretion of the City for a total potential term of 10 years and\nsix months, which has been previously approved by the BPW. The\nmaximum contract amount is $22,574,410 for the potential 10-year\nsix-month term and authority to execute is subject to City Attorney\napproval as to form.\nFiscal Impact Statement: The City Administrative Officer (CAO)\nreports that there there is no impact to the General Fund. The funding\nfor this contract will be provided by the Sewer Construction and\nMaintenance fund, which is a full cost recovery fund. Approval of the\nabove recommendation will result in potential expenditures of up to\n$22,474,410 over the 10-year six-month term. A total of $5 million is\napproved and available in the 2025-26 Sewer Construction and\nMaintenance Fund Contractual Services Schedule “Large Diameter\nSewer Structural Assessment” line for this contract. Future financing\nfor this contract will be requested through the annual budget process.\nThe Agreement includes Standard Provisions which contain a City\nobligation limitation clause which limits the City’s obligation to make\npayments to funds which have been appropriated for this purpose.\nFinancial Policies Statement: The CAO reports that the above\nrecommendation complies with City financial policies in that the City’s\nfinancial obligation is limited to funds budgeted for this purpose.
