A. REPEAL AND RE-ADOPT – AMENDMENT OF AN EXISTING PLANNED\nDEVELOPMENT OVERLAY ZONE, DEVELOPMENT AGREEMENT, TENTATIVE\nTRACT MAP, AND REVISED INITIAL STUDY/MITIGATED NEGATIVE\nDECLARATION FOR 201-217 S. SAN GABRIEL BOULEVARD\nPLANNING CASE NOS: ZC22-001, DA22-001, TMAP22-015, AND IS/MND\nAPPLICANT: EVERARDO GARCIA OF LCRA\n[ORDINANCE NO. 723] [RESOLUTION NO. 25-39]\nThis is a request to repeal and readopt an amendment to an existing Planned\nDevelopment Overlay Zone (PD) over an existing C-1 (Retail Commercial)\nzoning designation of the subject site, a Development Agreement (DA),\nTentative Tract Map No. 73153, and revised Initial Study/Mitigated Negative\nDeclaration to allow for the subdivision of air space for residential\ncondominium units within a mixed-use development. The property is\ndesignated General Commercial in the General Plan and zoned Retail\nCommercial/Planned Development Overlay (C-1/PD). The project was reviewed\nand approved by the City Council on January 16, 2024. The environmental\ndetermination was challenged. The project is brought back to provide\nadditional data and analyses on biological resources and health risks. No\nchanges have been made to the project scope and design since January 16,\n2024. The project would help maintain a balanced and vibrant economy by\ndeveloping a neglected and under-utilized site with a new development. The\napplicant will pay a number of fees to the City, including plan check, permits,\nand development impact fees. The City will additionally be in receipt of property\ntax by the sale and improvement of the project site. The Fiscal Year 2025-2026\nAdopted Budget includes the cost for required legal publication (Account No.\n121-702-00-65-000) and codification (Account No. 121-702-00-22-000) of the\nordinance, if adopted by the City Council.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\nproject was reviewed for compliance with the California Environmental Quality\nAct (CEQA). The City prepared an Initial Study (IS) to determine the proposed\nproject’s potential impact on the environment. The City has determined that the\nproject may have a significant effect on the environment, but by implementing\nthe identified mitigation measures, the project’s impacts could be reduced to less\nthan significant levels. Ten mitigation measures have been identified to reduce\nthese potential impacts to a less than significant level. The Mitigation Monitoring\nand Reporting Program (MMRP), which contains the full text of the mitigation\nmeasures, as well as identifies the responsible party for implementation and\ntiming, is provided as Attachment D.\nThe revised Initial Study/Mitigated Negative Declaration includes additional\nanalyses for biological resources and health risk assessment. Based on the field\nreconnaissance survey, database and literature searches, and overall assessment,\nthe proposed project area development is not likely to impact sensitive biological\nresources with the incorporation of mitigation measures. Additionally, the\nquantitative results presented in the health risk assessment report support the\nconclusion that project-related impacts related to carcinogenic TAC exposure\nwould be less than significant and no mitigation measures are required.\nThe 30-day public review period of the IS/MND was initiated on September 3,\n2025 and ended on October 2, 2025. A notice regarding the CEQA comment\nperiod was posted with the Los Angeles County Recorder, published in the San\nGabriel Sun newspaper, and distributed to relevant regulatory agencies.\nAdditionally, a notice was mailed to owners and occupants within 500-feet of the\nproject site.\nRecommended Action:\nStaff recommends that the City Council:\n1. Adopt Resolution No. 25-39 repealing Resolution No. 23-73 and adopting\na Revised Mitigated Negative Declaration and Mitigated Monitoring and\nReporting Program and approving Planning Case No. TMAP22-015 a\nRevised Tentative Tract Map No. 73153 for a mixed-use project; and\n5\n2. Waive full reading and introduce Ordinance No. 723 by title only:\nAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL,\nCALIFORNIA, REPEALING ORDINANCE NO. 700 AND APPROVING\nPLANNING CASE NOS. ZC22-001 AND DA22-001 TO AMEND AN\nEXISTING PLANNING DEVELOPMENT OVERLAY ZONE AND\nDEVELOPMENT AGREEMENT FOR A MIXED-USE DEVELOPMENT\nLOCATED AT 201-217 SOUTH SAN GABRIEL BOULEVARD\n3. Waive future reading of the Ordinance and schedule the second reading\nand adoption of the Ordinance for the next regular City Council meeting.\nThe Ordinance would then become effective 30 days after adoption.
