10.10 Consideration of a Resolution Approving a Contract Services\nAgreement with Horizons Construction Company Int’l, Inc. for\nthe Marlow Park Improvements\nRECOMMENDATION: It is staff’s recommendation that the City\nCouncil:\n1. Approve the plans and specifications for construction of the\nMarlow Park Improvements; and\n2. Adopt the attached Resolution approving an agreement with\nHorizons Construction Company Int’l, Inc. for Marlow Park\nImprovements; and\n3. Authorize the City Manager to execute the agreement and\napprove change orders that may be necessary during\nconstruction to cover any unforeseen condition in an amount\nnot to exceed 10% of the agreement amount; and\n4. Appropriate an additional $100,000 in General Funds to cover\nall construction and project management costs, including\ncontingency.\nCONCLUSION: If the attached Resolution is adopted, staff will\nprocess the agreement for signatures and issue a Notice to Proceed\nwith the Marlow Park Improvements to Horizons.\nFISCAL IMPACT: The contract services agreement amount is\n$910,903.09.\nThe City’s FY25-26 Capital Improvement budget includes $868,000 in\nMeasure A funds. An additional appropriation of $100,000 will be\nnecessary to cover the budget shortfall and any unforeseen\nconditions. Therefore, the total project budget for the construction\nphase of the Marlow Park Improvements is $968,000, consisting of\nMeasure A funds and general funds.\nATTACHMENTS:\nExhibit 1 - Resolution No. 2025-101\nExhibit 2 - Procurement Agreement Horizons
