(15)\n23-0600-S9\nEXEMPTION, COMMUNICATION FROM THE CITY ATTORNEY and\nORDINANCE FIRST CONSIDERATION relative to adjusting the Extra\nCapacity Refuse Collection Fee for the Bureau of Sanitation Solid\nResources\nProgram;\nand,\nORDINANCES\nSECOND\nCONSIDERATION relative to amending Article 6.1, Chapter VI of the\nLos Angeles Municipal Code (LAMC) to amend the Multi-Family Bulky\nItem Fee, the Solid Waste Collection, Transfer, Recycling, Recovery of\nWaste Resources, and Disposal Fee, and the Low Income Customer\nAssistance Program, and amending Subsections (a) and (m) of\nSection 5.121.5 of Article 7, Chapter 6, Division 5 of the Los Angeles\nAdministrative Code (LAAC) to change the fund administrator for the\nSolid Waste Resources Special Revenue Fund and the Multi-Family\nBulky Item Fee Special Revenue Fund.\nA. COMMUNICATION FROM THE CITY\nORDINANCE FIRST CONSIDERATION\nATTORNEY\nand\nRecommendations for Council action, SUBJECT TO THE\nAPPROVAL OF THE MAYOR:\n1. FIND that the California Environmental Quality Act\n(CEQA) does not apply to the creation of government\nfunding mechanisms or other government fiscal activities\nthat do not involve any commitment to any specific project\nthat may result in a potentially significant physical impact\non the environment; State CEQA Guidelines Section\n15378(b)(4). The draft Ordinance is, therefore, not subject\nto CEQA because it does "not involve any commitment to\nany specific project which may result in a potentially\nsignificant physical impact on the environment." Any\nCEQA-defined projects constructed from the funds\nreceived from the enactment of this ordinance will be\nsubject to a project-specific CEQA process before\nconstruction.\n2. PRESENT and ADOPT the accompanying ORDINANCE,\ndated September 22, 2025, amending Subsections B and\nE of Section 66.48 of Article 6.1, Chapter VI of the\nLAMC to adjust the Extra Capacity Refuse Collection Fee.\n(12 UNANIMOUS VOTES REQUIRED TO ADOPT\nORDINANCE ON FIRST CONSIDERATION)\nB. ORDINANCES SECOND CONSIDERATION\nRecommendations for Council action, SUBJECT TO THE\nAPPROVAL OF THE MAYOR:\n1. PRESENT and ADOPT the accompanying ORDINANCE,\ndated September 7, 2025, amending Subsections (a) and\n(d) of Section 66.40, Subsections (a) and (b) of Section\n66.41, and Subsection A of Section 66.48, of Article 6.1,\nChapter VI of the LAMC, to amend the Solid Waste\nCollection, Transfer, Recycling, Recovery of Waste\nResources, and Disposal Fee and the Low Income\nCustomer Assistance Program, and amending Subsection\n(a) of Section 5.121.5 of Article 7, Chapter 6, Division 5 of\nthe Los Angeles Administrative Code to change the fund\nadministrator for the Solid Waste Resources Special\nRevenue Fund.\n2. PRESENT and ADOPT the accompanying ORDINANCE,\ndated September 7, 2025, adding Subsections (f), (g), (h),\nand (i) to Section 66.40 of Article 6.1, Chapter VI, and\namending Subsections (c) and (e), and repealing\nSubsection (f), of Section 66.41 of Article 6.1, Chapter VI\nof the LAAC to amend the Multi-Family Bulky Item Fee,\nand amending Subsection (m) of Section 5.121.5 of Article\n7, Chapter 6, Division 5 of the LAAC to change the fund\nadministrator for the Multi-Family Bulky Item Fee Special\nRevenue Fund.\n(8 VOTES REQUIRED TO ADOPT ORDINANCES ON\nSECOND CONSIDERATION)\n(City Attorney reports dated September 7, 2025\nadopted at the Council meeting of October 7, 2025)\nFiscal Impact Statement: None submitted by the City Attorney.
