(13)\n24-0723\nCD 11\nENVIRONMENTAL\nIMPACT\nREPORT\n(EIR),\nMITIGATION\nMONITORING AND REPORTING PLAN, and STATEMENT OF\nOVERRIDING\nCONSIDERATIONS;\nand\nPUBLIC\nWORKS\nCOMMITTEE REPORT relative to the vacation of 92nd Street east of\nFalmouth Avenue and its easterly terminus, VAC-E1401449 (Vacation).\nRecommendations for Council action:\n1. FIND that the City has imposed all the mitigation measures that\nare within its control, as described in the Los Angeles\nInternational Airport (LAX) Northside Plan Update EIR\n(consisting of the Draft and Final EIRs) dated May 2014 and\nFebruary 2015, respectively (State Clearinghouse No.\n2012041003), attached to the Council file. The EIR was\nprepared by the Los Angeles World Airports (LAWA) in\ncompliance with the California Environmental Quality Act\n(CEQA) and included the Vacation.\n2. FIND that changes or alterations have been required in, or\nincorporated into, the Vacation that mitigate or avoid significant\neffects on the environment. Those mitigation measures are\ndescribed in the EIR and Mitigation Monitoring and Reporting\nPlan dated February 2015. A fully enforceable program for\nreporting or monitoring the changes required in the Vacation or\nmade a condition of approval to avoid or substantially lessen\nsignificant environmental effects has been required by the City.\nA copy of the Bureau of Engineering findings and relevant\nmitigation measures for concurrence adopting this as set forth\nin the CEQA Review Memo, dated April 14, 2025, attached to\nthe Council file.\n3. CONCUR with the Board of Airport Commissioners’ findings that\nthe unavoidable significant adverse operational and\nconstruction air quality related impacts associated with the\nproposed Vacation are acceptable in light of the economic,\nlegal, social, technological, and other benefits the proposed\nVacation will bring to the surrounding community and LAWA.\nThese specific overriding considerations are described in the\nStatement of Overriding Considerations for the LAX Northside\nPlan Update dated February 2015, attached to the Council file.\n4. CONCUR with the Board of Airport Commissioners’ findings that\nLulu’s Place Recreation Project as part of the LAX Northside\nCampus District development complies with the LAX Plan, any\ndesign guidelines and standards required by the LAX Specific\nPlan, and all applicable provisions of the LAX Specific Plan, as\nfully set forth in the Executive Director’s Report, attached to the\nCouncil file.\n5. FIND that no new information exists to show that the Vacation\nor circumstances of the Vacation have been changed to require\nadditional environmental review, as described in State CEQA\nGuidelines Section No. 15162; and, therefore the existing\nenvironmental documents adequately describe the potential\nimpacts for this Vacation.\n6. FIND that the street vacation proceedings pursuant to the\nPublic Streets, Highways and Service Easements Vacation Law\nbe instituted for the vacation of the public right-of way indicated\nbelow and shown on the map identified as Exhibit A, attached to\nthe Council file:\n92nd Street between Falmouth Avenue and its easterly terminus\n7. FIND that there is a public benefit to this Vacation. Upon\nvacation of the street, the City is relieved of its ongoing\nobligation to maintain the street. In addition, the City is relieved\nof any potential liability that might result from continued\nownership of the involved street easements.\n8. FIND that the Vacation is in substantial conformance with the\npurposes, intent and provisions of the General Plan, in\nconformance with Section 556 of the City Charter.\n9. FIND that the Vacation is not necessary for non-motorized\ntransportation facilities, in conformance with Section 892 of the\nCalifornia Streets and Highways Code.\n10. FIND that the Vacation is not necessary for present or\nprospective public use, in conformance with Section 8324 of the\nCalifornia Streets and Highways Code.\n11. ADOPT said City Engineer's report with the conditions\ncontained therein.\nFiscal Impact Statement: The City Engineer reports that the petitioner\nhas paid a fee of $47,080 for the investigation of this request pursuant\nto Section 7.42 of the Los Angeles Administrative Code (LAAC). Any\ndeficit fee to recover the cost pursuant to Section 7.44 of the LAAC\nwill be required of the petitioner. Maintenance of the public easement\nby City forces will be eliminated.

(15)\n23-0600-S9\nEXEMPTION, COMMUNICATION FROM THE CITY ATTORNEY and\nORDINANCE FIRST CONSIDERATION relative to adjusting the Extra\nCapacity Refuse Collection Fee for the Bureau of Sanitation Solid\nResources\nProgram;\nand,\nORDINANCES\nSECOND\nCONSIDERATION relative to amending Article 6.1, Chapter VI of the\nLos Angeles Municipal Code (LAMC) to amend the Multi-Family Bulky\nItem Fee, the Solid Waste Collection, Transfer, Recycling, Recovery of\nWaste Resources, and Disposal Fee, and the Low Income Customer\nAssistance Program, and amending Subsections (a) and (m) of\nSection 5.121.5 of Article 7, Chapter 6, Division 5 of the Los Angeles\nAdministrative Code (LAAC) to change the fund administrator for the\nSolid Waste Resources Special Revenue Fund and the Multi-Family\nBulky Item Fee Special Revenue Fund.\nA. COMMUNICATION FROM THE CITY\nORDINANCE FIRST CONSIDERATION\nATTORNEY\nand\nRecommendations for Council action, SUBJECT TO THE\nAPPROVAL OF THE MAYOR:\n1. FIND that the California Environmental Quality Act\n(CEQA) does not apply to the creation of government\nfunding mechanisms or other government fiscal activities\nthat do not involve any commitment to any specific project\nthat may result in a potentially significant physical impact\non the environment; State CEQA Guidelines Section\n15378(b)(4). Accept the grant award in the amount of $61,224 from the\nState of California Department of Justice.\nc. Execute a vendor agreement with JSI Research Inc.\nd. Prepare Controller instructions for any necessary\ntechnical adjustments, subject to the approval of the City\nAdministrative Officer; and, request the Controller to\nimplement the instructions.\n2. AUTHORIZE the Department of Recreation and Parks (RAP) to\nretroactively submit three Work Plans as detailed in Attachment\nNo. 1 contained in the Proposition K – L.A. For Kids Steering\nCommittee report dated August 29, 2025 (Report), attached to\nCouncil file No. 25-1016, to the County of Los Angeles Regional\nPark and Open Space District (RPOSD) under the Measure A\nRESTORE program for the George Wolfberg Park, Wattles\nGarden Park, and Temescal Canyon Park (Projects).\n2. AUTHORIZE the General Manager, RAP, to accept the funds for\nthe amount, scope, and the performance period outlined in said\nAttachment, subject to the approval of the Mayor and City\nCouncil pursuant to Section 14.6(c) of the Los Angeles\nAdministrative Code.\n3. DESIGNATE the General Manager, RAP, or designee, as the\nagent to conduct all negotiations, execute and submit all grant\ndocuments, including, but not limited to applications,\nagreements, amendments, and payment requests, which may\nbe necessary for the acceptance and use of Measure A\nRESTORE Program funding for the Projects.\n4. AUTHORIZE the General Manager, Department of Cultural\nAffairs, or designee, to:\na. Submit all necessary paperwork of the Curatorial\nResearch Grant application to the Teiger Foundation.\nb. Accept a grant award on behalf of the City from the Teiger\nFoundation in the amount of $50,000.\nc. Negotiate and execute the Grant Authorization Letter on\nbehalf of the City, and submit the required expenditure\nreport relative to the program aspects of the grant.\nd. Receive and expend the Teiger Foundation grant funds for\nactivities for all eligible purposes.\ne. Prepare any Controller’s instructions needed to implement\nactions approved by the Council and Mayor on matters\npresented in, or deriving from, the transmittal, and/or to\nmake necessary technical adjustments; and, further,\nrequest the Controller implement these instructions.\n2. AUTHORIZE the transfer of $8,404,588.73 from the\nUnappropriated Balance, Ground Emergency Medical Transport\nQAF Program line item, to LAFD Fund No. 100/38, Account No.\n003040 (Contractual Services).\n2. DIRECT the LAFD to electronically transfer $8,404,588.73 from\nLAFD Fund No. 100/38, Account No. 003040 (Contractual\nServices), to the State Department of Health Care Services by\nno later than October 17, 2025 for the LAFD’s payment for\nparticipation in the PP-GEMT Intergovernmental Transfer (IGT)\nProgram.\n3. AUTHORIZE the LAFD to deposit revenue received as part of\nthe PP-GEMT IGT Program into LAFD Fund No. 100/38,\nRevenue Source Code 4451 (Emergency Ambulance Services).\n4. (20)\n25-0882\nBUDGET AND FINANCE COMMITTEE REPORT relative to a transfer\nof funds to balance salary accounts impacted by overtime costs for the\nLos Angeles Fire Department (LAFD).\nRecommendations for Council action, pursuant to Motion (Lee –\nMcOsker), SUBJECT TO THE APPROVAL OF THE MAYOR:\n1. AUTHORIZE the Controller to transfer $3,000,000 from the\nUnappropriated Balance Fund No. 100/58, Mutual Aid Account\nNo. 580274, and $7,000,000 from Salaries Sworn Account No.\n001012, for a total of $10,000,000 to Overtime Sworn Account\nNo. 001092 to cover projected funding needs in this account\nthrough at least mid-year.\n2. (21)\n25-1103\nCD 5\nPLANNING AND LAND USE MANAGEMENT and HOUSING AND\nHOMELESSNESS COMMITTEES’ REPORT relative to authorizing the\nnecessary permits to allow for the demolition of the single-family\nresidence and Accessory Dwelling Unit (ADU) located at 9019 Monte\nMar Drive.\nRecommendations for Council action, pursuant to Motion (Padilla for\nYaroslavsky - Lee):\n1. DIRECT the Los Angeles Housing Department (LAHD),\nDepartment of City Planning (DCP), Department of Building and\nSafety (DBS), and any other relevant departments, in\nconsultation with the Office of the City Attorney, to authorize the\nnecessary permits to allow for the demolition of the single-family\nresidence and ADU at 9019 Monte Mar Drive, given the\npresence of black mold within the structures, and to allow for\nthe desired rebuilding of the single-family residence with an\nattached junior ADU, in conformance with all applicable City\ncodes.\n2. DIRECT the DCP, in consultation with the Office of the City\nAttorney, DBS, and LAHD, to report to Council within 30 days\non recommended changes, either administrative or statutory, to\nthe implementation of the Resident Protection Ordinance\n(RPO), Rent Stabilization Ordinance (RSO), and/or to any other\nrelevant local ordinances, implementation memorandum,\napplicant guidance, etc., to allow for owner occupied singlefamily homeowners to demolish their residence(s) without\ntriggering housing replacement requirements, particularly when\nthere are serious environmental or health conditions, while still\nensuring conformance with the Housing Crisis Act and any\nother relevant state and local statutes.\nFiscal Impact Statement: Neither the City Administrative Officer nor\nthe Chief Legislative Analyst has completed a financial analysis of this\nreport.

(22)\n25-1066\nPUBLIC SAFETY COMMITTEE REPORT relative to accepting a nonmonetary donation for the purchase of equipment lockers to benefit the\nLos Angeles Police Department (LAPD) Central Area Patrol Officers.\nRecommendation for Council action:\nAPPROVE the acceptance of a non-monetary donation for the\npurchase of equipment lockers to benefit the LAPD Central Area\nPatrol Officers, valued at $50,000, from the Los Angeles Police\nFoundation; and, THANK the donor for this generous donation.\nFiscal Impact Statement: None submitted by the Board of Police\nCommissioners.
