3.\nCITYWIDE HIGH-SPEED FIBER INTERNET SERVICE - City Council consider\napproval to grant access to the City's right-of-way and lease dark fiber strands to Aspire\nBroadband to build, own, and operate a Fiber to the Premises network to deliver Citywide\nHigh-Speed Fiber Internet Service to businesses and residents.\nRECOMMENDED ACTION:\nCity Council:\n1. Determine that the project is exempt from environmental review pursuant to\nCalifornia Environmental Quality Act Guidelines § 15301, 15303, and 15304, as a\nClass 1 (Existing Facilities), Class 3 (New Construction of Small Structures) and\nClass 4 (Minor Alterations to Land) categorical exemption.\n2. Approve a 20-year, non-exclusive Agreement with three additional, optional and\nsuccessive, 10-year terms, with Aspire Broadband Holdings, Inc. for access to and\nuse of the City’s right-of-way for fiber optic cable installation and accessory facilities\nfor its network; inclusive of a lease of certain City-owned dark fiber strands, subject\nto availability and to detailed terms set forth in the Agreement.\n3. Authorize the City Manager or designee to execute the Agreement in substantially the\nform provided in the City Clerk’s reading file, subject to City Attorney approval, with\nsuch non-substantive revisions as approved by the City Manager and City Attorney.\nCONSENT CALENDAR\nAll matters listed under the Consent Calendar are considered routine and will be enacted by one\nmotion by the City Council. The items are not individually discussed by the City Council unless\na request is made by a member of the public or the Council, in which case, the item(s) will be\nremoved from the Consent Calendar and will be considered separately.
